U.S. POSITION PAPERS SENT VIA E-MAIL TO UNVIE ¶1. The Department appreciates Mission,s analysis and recommendations for the March IAEA Board of Governors (BoG) meeting (reftel). Instructions for U.S. delegation (USDEL) follow. U.S. position papers and any statements may be modified as the USDEL believes appropriate. USDEL should also deliver statements sent by e-mail. The agenda for this BOG is found in document GOV/2010/1, January 25, 2010. ¶2. AGENDA ITEM 1 - Introductory Statement by the Director General (DG) The statement will be available after delivery. No U.S. action necessary. USDEL should fax or e-mail the DG,s statement to IO/GS immediately following its delivery. ¶3. AGENDA ITEM 2 - Applications for membership of the Agency The IAEA Secretariat has not received any new requests for membership and this item is currently expected to be dropped from the agenda. Mission will advise via e-mail if any membership applications are received prior to the BoG session. ¶4. AGENDA ITEM 3 - Measures to strengthen international cooperation in nuclear, radiation, transport and waste safety a) Nuclear Safety Review for 2009 ISSUE: The Board will be asked to take note of the Nuclear Safety Review, "Measures to Strengthen International Cooperation in Nuclear, Radiation and Transport Safety and Waste Management," (GOV/2010/4). This report is supplemented by two Notes: "Safety related events and activities worldwide during 2009" (2010/Note 4) and "The Agency,s safety standards: activities during 2009" (2010/Note 5). U.S. POSITION: USDEL may join consensus in taking note of the information contained in this report. b) Draft Safety Requirements: disposal of radioactive waste (GOV/2010/2) ISSUE: The Board will have before it the report and will be asked to consider and approve the Safety Requirements on the disposal of radioactive waste. U.S. POSITION: USDEL should concur in the establishment of the draft Safety Requirements publication as an Agency safety standard and authorize the DG to promulgate these Safety Requirements and issue them as a Safety Requirements publication in the IAEA Safety Standards Series. c) Draft Safety Requirements: governmental, legal and regulatory framework for safety (GOV/2010/3) ISSUE: The Board will have before it the report and will be asked to consider and approve the Safety Requirements on the governmental, legal and regulatory framework for safety. U.S. POSITION: USDEL should concur in the establishment of the draft Safety Requirements publication as an Agency safety standard and authorize the DG to promulgate these Safety Requirements and issue them as a Safety Requirements publication in the IAEA Safety Standards Series. ¶5. AGENDA ITEM 4 - Strengthening the Agency,s activities related to nuclear science, technology and applications: Nuclear Technology Review - 2010 (GOV/2010/5) ISSUE: The Board will have before it the DG,s report and will be asked to take note of the report. U.S. POSITION: USDEL should reaffirm U.S. support for nuclear power as an important and clean energy source and our support for the safe and secure expansion of nuclear power in developing countries in a manner that limits proliferation dangers and applies the highest standards for safeguards and security. U.S. support should also be expressed for non-power applications in the areas of food security, human health, environmental protection, and water resource management to benefit socio-economic development nationally, regionally, and inter-regionally. ¶6. AGENDA ITEM 5 - The Future of the Agency ISSUE: The Board will have before it in GOV/2010/17 a report by the Chairman of the informal and open-ended process of Member States on the "Future of the Agency." U.S. POSITION: USDEL should take note of the report. Should other Board Members seek to make substantive changes to the text of the report, USDEL should intervene, as appropriate, to ensure that U.S. interests are protected and the report remains factual and balanced. ¶7. AGENDA ITEM 6 - Nuclear Verification (a) The conclusion of safeguards agreements and of additional protocols ISSUE: The Board will have before it a proposal for conclusion of an Additional Protocol with Gambia (GOV/2010/6),and for a Comprehensive Safeguards Agreement (GOV/2010/15) and Additional Protocol (GOV/2010/16) with Angola. U.S. POSITION: USDEL should join consensus in approving any safeguards agreements or Additional Protocols that conform to the standard models. (b) Application of safeguards in the DPRK ISSUE: The Board will consider the status of verification and monitoring in the DPRK. U.S. POSITION: The United States will not accept North Korea as a nuclear weapon state. USDEL should use the cleared statement to reaffirm U.S. commitment to achieving the verifiable denuclearization of the Korean peninsula and reaffirm support for the expeditious resumption of the Six-Party Talks. (c) Implementation of the NPT safeguards agreement and relevant provisions of Security Council Resolutions 1737 (2006),1747 (2007),1803 (2008) and 1835 (2008) in the Islamic Republic of Iran. ISSUE: The Board will have before it for discussion the DG's report (GOV/2010/10) on the status of the implementation of the IAEA,s Safeguards Agreement in Iran and relevant provisions of UN Security Council Resolutions 1737, 1747 and 1803, and the Secretariat,s efforts to complete its investigation into Iran,s nuclear activities. U.S. POSITION: The U.S. position paper and statement will be sent septel. (d) Implementation of the NPT safeguards agreement in the Syrian Arab Republic ISSUE: The Board will discuss the DG,s report (GOV/2010/11) on the status of the implementation of the NPT safeguards agreement in the Syrian Arab Republic. U.S. POSITION: The U.S. position paper and statement will be sent septel. (e) The Staff of the Department of Safeguards to be used as inspectors ISSUE: The Board is asked to approve, as safeguards inspectors, a new staff member of the Agency (GOV/2010/12, 18 February 2010). U.S. POSITION: USDEL should join consensus on the adoption of the list. ¶8. AGENDA ITEM 7 - Follow-up to decisions on personnel matters taken by the UN General Assembly ISSUE: The Board of Governors will be asked to approve a new base/floor salary scale based on changes made by the UN General Assembly (A/RES/64/231) for Professional and higher category staff members ( 3.04%) and separately to adjust the DG salary. U.S. POSITION: USDEL may join consensus in approving the proposed revised salary scale for Professional and higher category staff members as well as the salary for the DG. ¶9. AGENDA ITEM 8 - Any other business (a) Assurance of fuel supply ISSUE: The division over the issue between developed countries seeking to devise mechanisms to discourage the spread of sensitive technologies and developing states concerned about being denied the commercial advantage of nuclear development may hinder the approval of other fuel assurance proposals under development such as the IAEA,s International Nuclear Fuel Bank (INFB). U.S. POSITION: USDEL should keep the issue alive and encourage continued discussion, with a view towards possible action on the INFB at the June BoG meeting. (b) Nuclear security summit ISSUE: The USDEL will make a statement under "Any other Business" about the Nuclear Security Summit, scheduled for April 12-13 in Washington, DC. U.S. POSITION: The U.S. position paper and statement will be sent septel. (c) Iraq Additional Protocol ISSUE: USDEL may draw from a contingency statement, particularly if it is referenced by the DG in his opening remarks, welcoming Iraq's provisional implementation of the Additional Protocol and the adoption by the UNSC of a PRST lifting WMD sanctions on Iraq.
