Reason: 1.4 (b) and (d).
1. (S) Guidance: Delegation is authorized to drop Article
VI from the Treaty now that the Russian delegation has
agreed to codify: the use of unique identifiers on all
ICBMs, SLBMs, and deployed heavy bombers; that the sides
will provide 48-hour advance notification of new missile
exits from production facilities; and that the inspecting
party shall have the right to cancel an inspection if
fewer than 50 percent of deployed ICBMs are available for
inspection at an ICBM base. This guidance supersedes the
guidance in para 11 of reftel.
2. (S) Washington notes that the Russian delegation has
not agreed to codify a requirement that ICBM bases for
mobile launchers of ICBMs not exceed 125,000 sq km, nor
that their basing areas not exceed 5 sq km. Washington
understands the U.S. Delegation will send a request for
guidance to Washington proposing a way forward on this
issue, to include how to address locational restrictions
on non-deployed mobile ICBMs and non-deployed mobile
launchers at mobile ICBM bases. Washington believes
meaningful locational restrictions on non-deployed mobile
ICBMs and non-deployed mobile launchers must be maintained
in this Treaty.
