SUMMARY
1. (U) The Chimbalanga-Mojenza same-sex couple trial resumed
today. The prosecution presented two witnesses and then rested its
case. In response to the prosecution's testimony, the couple's
attorney requested a continuance to prepare a defense. The
presiding magistrate granted the request and the case is now
scheduled to resume March 22. The two defendants remain in jail
without bail. There was no action on the Tony Chirwa case. End

TRIAL RESUMES WITH TWO PROSECUTION WITNESSES
2. (U) The trial of same-sex couple Tiwonge Chimbalanga and Steve
Mojenza resumed today in the Blantyre Magistrate Court. The
prosecution presented two witnesses. The first witness was the
Principal Psychiatry Clinical Officer from Zomba General Hospital
who testified that Chimbalanga was "mentally stable," but suffered
from a "gender identity disorder." The witness also stated that
further examination was needed to confirm the diagnosis.
3. (U) The second witness was the arresting officer from the
Blantyre station of the Malawi Police Station. His testimony
consisted of a recounting of the events leading up to the arrest of
the defendants. The prosecution then rested.
CONTINUANCE GRANTED
4. (U) Defense attorney Mauya Msuku then requested a continuance
to prepare a defense. (Note: Up to this point in the trial, it
had been unclear if the couple's counsel would prepare a defense or
ask for a summary judgment. End note.) The presiding magistrate
granted the request and scheduled the case to resume on March 22.
The defendants will remain in jail without bail.
