Place: Russian Mission, Geneva -------------- SUMMARY -------------- ¶3. (S) At the Notifications Working Group meeting co-chaired by Mr. Siemon and Colonel Ryzhkov on February 2, the sides continued discussion of notifications concerning inspections and exhibitions from the U.S.-Proposed Joint Draft Text (JDT),dated December 15, 2009 ("Part Four of the Protocol to the Treaty: Notifications"), and initially discussed on December 17, 2009. The U.S. side provided its official translation of the Russian proposed JDT of Part IV of the Treaty Protocol (Notifications),which was delivered to the United States on December 31, 2009. (U) SUBJECT SUMMARY: Section VI Notifications Concerning Inspections and Exhibitions. -------------- SECTION VI: NOTIFICATIONS CONCERNING INSPECTIONS AND EXHIBITIONS -------------- ¶5. (S) LTC Leyde and Ryzhkov discussed Section VI of the text, specifically the time period related to the notification of the intention to conduct an inspection. (Begin comment: This was a repeat of the discussion that had taken place at the last working group meeting of Session VII held on December 17, 2009 (Ref A). End comment.) ¶6. (S) In paragraph 9, the Russian side supported providing the notification not less than 72 hours in advance of the estimated time of arrival at the point of entry because it permitted additional time for the inspected Party to arrange logistics for the inspection team. The United States continued to support a 16-hour time period. 
 ¶7. (S) Discussion on the portion of U.S. paragraph 9 which described notification of a flight plan for an inspection airplane ensued. The Russian side noted the formulation "no less than 3 hours" had been previously agreed versus "no less than 48 hours." All other brackets remained in this paragraph. ¶8. (S) In U.S. paragraph 10, the U.S. side agreed to delete its proposed text "no later than 24 hours after the change" from sentence one and the Russian brackets in the sentence were moved accordingly. The sentence referencing specific details of the flight route were removed to Tier III, per agreement of both sides. The resulting paragraph now read as follows: Begin text: ((10))1((4))2 . Notification of the change to a flight route of inspection airplanes to or from a point of entry established on the territory of a Party shall be provided by that Party no less than 30 days prior to the date of implementation of such a change.))2 End text. ¶9. (S) In paragraph ((11))1((10))2 the sides accepted the first sentence from the Russian-bracketed text and moved the remainder of the Russian-bracketed text to Tier III. The resulting paragraph reads as follows: Begin text: ((11))1((10))2. Notification of the determination in accordance with Part Five of this Protocol and its Annexes of agreed geographic coordinates of a reference point used at a point of entry for operability checks of satellite system receivers shall be provided by the inspected Party no later than 30 days after the entry into force of the Treaty. End text. ¶10. (S) In paragraph ((12))1 the sides deleted the U.S.-bracketed text "Notification, at least 48 hours prior to a change, of the intention to change a reference point for satellite system receivers at a point of entry." The sides agreed to add the Russian-bracket text "Comment: The inspected Party shall provide supplementary messages on changes to the reference points used for operability checks of satellite system receivers" to the preceding paragraph ((11))1((10))2. ¶11. (S) The sides agreed to leave the text in paragraph ((13))1((11))2 bracketed until issues related to site diagrams and inspection boundaries were agreed within either the Inspection Protocol or Memorandum of Understanding (MOU) Working Groups. The time determination for this notification was a key issue. As such, "five" was replaced with "X" in the U.S-bracketed first sentence of the paragraph. The resulting paragraph was as follows: (Begin comment: The sides had previously agreed that this part of the Annex on Inspection Activities would be included in the package for signature. End comment.) Begin text: ((13))1((11))2. Notification, no later than X days after a change, of a change to the boundary of a facility specified on a site diagram.))1 ((Notification of a change to the boundaries of an inspection site. Such notification shall be provided after agreement within the framework of the BCC on changes to the boundaries of the inspection site.))2 End text. ¶12. (S) In paragraph ((14))1((12))2 brackets were removed from the Russian-proposed text "Such a notification shall be given no less than 15 days in advance of the planned date of the exhibition." The number "15" was changed to "X" to indicate that the number of days would be negotiated at a later time. The sides agreed to move the remainder of the Russian-bracketed text: "The notifications shall include the date of the initiation and location for the exhibition, the point of entry, type, and, if applicable, category or version of strategic offensive arm subject to exhibition, the distinguishing features and technical characteristics of new types of SOA, the results of conversion or elimination of the first item of a specified type." to Tier III. The resulting paragraph read as follows: Begin text: ((14))1((12))2. Notification of intent to conduct an exhibition of strategic offensive arms. Such a notification shall be given no less than X days in advance of the planned date of the exhibition. End text. ¶13. (S) The U.S. side accepted the Russian-proposed text of paragraph ((15))1((13))2, "Notification, of agreement to participate in an exhibition of strategic offensive arms. Such a notification shall be given no less than 72 hours in advance of the planned date of the exhibition." ¶14. (S) Under the subsection "Notifications provided by the inspection team leader," the U.S. side accepted paragraphs 14, 17, and 18 from the February 2, 2010, U.S. Official Translation of the Russian-Proposed Joint Draft Text Part Four of the Protocol to the Treaty: Notifications (Ref B). (Begin comment: This text was provided by Russia on December 31, 2009. End comment.) Begin text: ¶14. Notification of designation of type and site of inspection. The notification shall be provided at the point of entry no later than fours hours after the estimated time of arrival or no later than four hours after the actual time of arrival, if the actual time of arrival is later than the estimated time of arrival. ¶17. Notification of cancellation of inspection. Such a notification shall be provided at the point of entry or at the inspection site in those cases, when the inspection may not be conducted in accordance with Part Five of this Protocol. ¶18. Notification of designation of an item intended for inspection during a Type One inspection. Such a notification shall be given at the inspection site after completion of pre-inspection procedures.
