1. (U) Austrian MFA delivered an electronic copy of a
Diplomatic Note, dated 3 July 2009, on lost and stolen
passports to the Embassy on July 7. Operative text follows:

The Ministry has noted the U.S. statutory requirements set
forth in the implementing Recommendations of the 09/11
Commission Act of 2007, Pub.L.No.110-53, and specifically the
requirement that each member of the Visa Waiver Program enter
into an agreement with the United States to report or make
available to the United States through INTERPOL or other
acceptable means, information about lost and stolen passports
within a strict time limit and in a manner specified.
On behalf of the Government of Austria, the Federal Ministry
for European and International Affairs is pleased to inform
the Government of the United States of America that Austria
intends to continue reporting lost and stolen passports to
INTERPOL in compliance with relevant INTERPOL rules,
regulations and performance standards and European Union
Common Position 2005/69/JHA of January 24, 2005, on
exchanging certain data with INTERPOL, and to make available,
through appropriate INTERPOL mechanisms, statistics
demonstrating the observance of these standards.
On behalf of the Government of Austria, the Federal Ministry
for European and International Affairs approves that the note
of the Embassy of the United States and this reply from the
Ministry constitute a shared understanding between our two
Governments.

2. The MFA has confirmed that the original hard copy of the
text has also been sent to the Embassy. The electronic copy
of the Note has been e-mailed to the Visa Waiver Office
(Frey) in DHS.
