1. (C//NF) Summary: On May 13, the European Commission
committed to a 1.75 million euro program to support regional
judicial capacity for pirate prosecutions in East Africa.
The EU hopes this program, which will be implemented in
concert with the UN, will allay the Government of Kenya's
concerns about being overstretched and underfunded for pirate
prosecutions. The approval of this initiative highlights the
EU's efforts to work across institutions, with both hard and
soft power, to combat piracy off the Horn of Africa. We can
leverage this commitment if we, too, take a
whole-of-government approach and continue to engage the EU
both militarily and diplomatically. End Summary.


2. (SBU) On May 13, the European Commission (EC) committed
to a 1.75 million euro program to support regional judicial
capacity for pirate prosecutions in East Africa. The joint
EC-UNODC program will support the Government of Kenya,s
efforts to accept, detain, and prosecute piracy suspects, and
will fund an initial review of piracy legislation in Tanzania
and the Seychelles, as well as an exchange of legislative and
judicial counter-piracy lessons learned among countries in
the region. This program has been approved by Commission
authorities and now awaits an implementing agreement with
UNODC, which the EC expects to sign soon. We do not yet know
the details of how the program will be implemented.


3. (C//NF) A contact in the EC told PolOff on May 13 that
the GoK has repeatedly threatened to stop accepting
EU-captured pirates for prosecution if the EU does not
increase its aid to the Kenyan judicial system. According to
a separate contact at the EU's operational headquarters, on
May 7 the Kenyan MFA sent a letter to the Czech EU Presidency
accepting delivery of 11 EU-detained pirates for prosecution,
but notifying the EU that "any future undertaking and
prosecution on the Kenyan part of transferred persons shall
be predicated and dependent upon the donors meeting all the
expenses relating thereto." (Note: A copy of the letter was
passed to USEU and will be forwarded to EUR via email. End
Note.) The EC official tells us that the EU hopes the new
program will answer the Kenyan concerns, although it will not
cover all of Kenya,s previous requests, such as for
monitoring and security equipment for Kenyan prisons. In a
letter this week to the GoK asking to deliver another group
of 14 pirates, the EU referred to the pending approval of the
EC's program, and an EC contact tells us the EU will hand

over the 14 pirates on May 15 if the GoK is satisfied.


4. (C//NF) Comment: This situation highlights the
difficulty of making sustainable legal arrangements for the
delivery of captured pirates, but also demonstrates the EU's
flexibility in responding to Kenyan concerns. Moreover, the
EC's action shows that the EU is coordinating its hard and
soft power, matching its naval operation with a complementary
program to help build regional judicial caacity. A second
Commission program (reftel) will introduce a long-term
maritime security initiative for the Horn of Africa region
beginning this fall. We can leverage the EU's multi-faceted
commitment if we, too, take a whole-of-government approach
and continue to engage both militarily and diplomatically.
