ASSISTANCE AGREEMENT 119-00

1. This is an Action Request. See paragraphs 2-4.
2. The Department's Office of Defense Trade Controls
Compliance
(PM/DTCC) requests Embassy's assistance in conducting a Blue
Lantern check on License 050071419 in furtherance of
Technical
Assistance Agreement (TAA) 119-00 for the export of
International Traffic in Arms Regulations (ITAR)-controlled
defense hardware to Singapore. Embassy is requested to
complete
this Blue Lantern inquiry within 45 days. Lack of response
to a
Blue Lantern inquiry will affect pending and future licenses
involving parties to this license.
3. Reason for Request: The Department seeks to ensure that
Lockheed Martin has not exceeded the scope of the approved TAA
and associated limitations, provisos and other requirements,
and to confirm that the end-user received all of the
authorized
United States Munitions List (USML) items licensed under
50071419
and that they are being used for the authorized purpose.
4. ACTION: Embassy should make inquiries to determine if
Lockheed
Martin is working within the scope of the original agreement
and
abiding by the provisos (explaining constraints and limits on
technology transfer) governing work on this agreement.
Conduct a
site visit to Lockheed Martin Global, Singapore in order to
provide the Department with an assessment of the company's
operations and on-site security. Verify hardware receipt.
(Recommended questions for Lockheed Martin Global, Singapore):
- Is the company aware of the technical constraints placed
by
the USG on TAA 119-00? How are they typically advised of
constraints on licenses?
- Specifically, please verify that Lockheed Martin Global,
Singapore is familiar with and abiding by the following
provisos:
(1) U.S. software source code, operating algorithms, or
program
maintenance documentation must not be released/offered.
Transfer
of the software source code must be the subject of a
separate,
specific request. This request should comply with the
Department
of Defense Guidelines for International Transfers of Software
Documentation (including Source Code) dated 7 April 2007;
(2) USG COMSEC/TRANSEC and TEMPEST must not be
released/offered;
(3) Maintenance or training of repair of USG
COMSEC/TRANSEC and
TEMPEST is not authorized via this agreement;
(4) Detailed design data or manufacturing know-how must
not be
released/offered;
(5) U.S. threat, intelligence, or vulnerability
information
must not be released/offered.
