(SBU) Night Action precedence required due to action requested in advance of scheduled United Nations Security Council meeting at 1500 EDT Monday, April 13. ¶2. (SBU) Addressees are requested to make an urgent demarche in their capitals, at the highest appropriate level, drawing on the information in this paragraph and in paragraph 3 below, to seek support of the host government and of its UN Mission for a draft presidential statement (PRST) about the recent North Korean missile launch. This draft has achieved the support of the five permanent members of the Council and of Japan, and represents a delicate balance of interests. We would discourage further edits. We seek a consensus adoption by the whole Security Council to promptly send a strong and unified message to the DPRK. The PRST is currently under a silence procedure, which, if unbroken, would permit its adoption as soon as 3 p.m. EDT on Monday, April 13. ¶3. (SBU) The draft that has been shared clearly and unequivocally condemns the April 5 launch. It makes plain that this launch contravenes Security Council Resolution 1718. It demands that the DPRK not conduct any further launch, and calls upon the DPRK as well as all member states to fully implement their obligations under 1718. It also states that there will be additional strengthening of the measures in 1718 through the designation of additional entities and goods that are subject to sanctions. The entities, once designated, would be subject to an asset freeze. Once additional goods are designated, all states would be prohibited from supplying these goods to, or procuring of these goods from, the DPRK. This PRST would be a strong outcome from the Security Council, and meets all our objectives. ¶4. BEGIN TEXT The Security Council bears in mind the importance of maintaining peace and stability on the Korean peninsula and in northeast Asia as a whole. The Security Council condemns the launch by the Democratic People's Republic of Korea (DPRK) on 5 April 2009, local time, which is in contravention of Security Council resolution 1718 (2006). The Security Council reiterates that the DPRK must comply fully with Its obligations under Security Council resolution 1718 (2006). The Security Council demands that the DPRK not conduct any further launch. The Security Council also calls upon all Member States to comply Fully with their obligations under resolution 1718 (2006). The Security Council agrees to adjust the measures imposed by Paragraph 8 of resolution 1718 (2006) through the designation of entities and goods, and directs the Committee established pursuant to resolution 1718 (2006) to undertake its tasks to this effect and to report to the Security Council by 24 April 2009, and further agrees that, if the Committee has not acted, then the Security Council will complete action to adjust the measures by 30 April ¶2009. The Security Council supports the Six Party Talks, calls for their early resumption, and urges all the participants to intensify their efforts on the full implementation of the 19 September 2005 Joint Statement issued by China, the DPRK, Japan, Republic of Korea, the Russian Federation and the United States and their subsequent STATE 00035897 002.2 OF 002 consensus documents, with a view to achieving the verifiable denuclearization of the Korean Peninsula in a peaceful manner and to maintaining peace and stability on the Korean Peninsula and in northeast Asia. The Security Council expresses its desire for a peaceful and diplomatic solution to the situation and welcomes efforts by Council members as well as other Member States to facilitate a peaceful and comprehensive solution through dialogue.
