ON END-USER CERTIFICATES
1. (U) This is an action message.
2. (U) In 2008 the Forum for Security Cooperation (FSC)
took decision FSC.DEC/12/08 on "Information Exchange with
Regard to Sample Formats of End-user Certificates and
Relevant Verification Procedures," which requested all
participating States to submit a sample format of their
end-user certificate and/or other pertinent documents to all
other pS and the Conflict Prevention Center (CPC) by March
27, 2009. For the purpose of this decision, the
identification of the end-user and verification of end-usage
is accomplished by means of U.S. Department of State
"Non-Transfer and Use Certificate," DSP-83. Mission is
requested to distribute a copy DPS-83 as appropriate before
March 27, 2009. In addition, in accordance with operative
para 2 of FSC.DEC/12/08, mission is requested to provide the
following additional information in the appropriate format.
--Begin Submission--
In addition to the sample format of U.S. Department of State
DSP-83, the United States offers the following additional
information on end-use verification.
-- The U.S. Department of State Directorate of Defense Trade
Controls (DDTC) is charged with controlling the export and
temporary import of defense articles and defense services.
DDTC maintains a public access web site
(www.pmddtc.state.gov) which provides detailed information on
U.S. regulations and procedures covering the export and
import of defense articles. With regard to FSC.DEC/12/08,
the DDTC site includes information on, inter alia:
- Department of State "Non-Transfer and Use Certificate,"
DSP-83,
- End-user verification,
- Annual End-user Monitoring Reports, which describe
actions U.S. Department of State has taken under relevant
national legislation to implement end-user monitoring of
commercial export of defense articles, services and related
technical date subject to licensing; and
- Compliance Program Guidelines
