Summary
1. This is the second cable providing FY 2009
Department of State Financial Operating Guidance. The
Congress has passed, and the President is expected to
sign, a short term Continuing Resolution (CR) to fund
agencies for which FY 2009 Appropriations are not yet
enacted, including funding for State and Foreign
Operations, through Wednesday March 11, 2009 (HJ Res.
38). The Congress continues working on the FY 2009
Omnibus Appropriations bill to provide funding through
the remainder of the fiscal year before this short term
CR expires. End summary.
Continuing Resolution Funding Availability
2. The Congress has passed, and the President is
expected to sign into law a second FY 2009 CR (HJ Res.
38),funding government operations from March 7, 2009
through March 11, 2009. The funding levels for State and
Foreign Operations under this CR are continued at the
same rate as provided under the initial FY 2009 CR (Div.
A, PL 110-329).
Reminder to Exercise Spending Restraint
3. Funds appropriated under this short term CR may not
be used to initiate or resume any project or activity
for which appropriations, funds, or other authority was
not available under the terms of the previous CR. CRs
essentially preserve the status quo so that the
Department can continue its current operations, albeit
at constrained levels. Bureaus and Posts are reminded to
exercise spending restraint until full year funding
levels are provided. Operating guidance provided in
reftel remains in effect. We will continue to keep you
apprised of Congressional actions.
Message From The Department's Procurement Executive
4. The Department's Procurement Executive provides the
following reminder: All requisitions, including those
for continuing services should be submitted to your
contracting officer with the notation "Subject to the
availability of funds" appearing clearly, as is the
usual practice. All requisitions for any new services
also should be submitted with the notation "Subject to
the availability of funds", as per usual practice.
However, under no circumstances may a purchase order or
contract award be authorized or made without sufficient
funds being available at the time the obligation is
incurred. To do so could result in a violation of the
Anti-Deficiency Act.
