(U) This is an action request. All action addressees, please see paragraphs 5-7. Paragraphs 8-17 contain instructions or further background information for specific posts. -------------- SUMMARY AND OBJECTIVES -------------- ¶2. (SBU) The United States Government is in the final stages of reviewing the third tranche of names circulated by the UN (al-Qaida/Taliban Sanctions) Committee chair in furtherance of the committee's work toward completing a comprehensive review by June 2010 of the UN 1267 Consolidated List, as mandated in paragraph 25 of UNSCR 1822. Department would like at this time to share with partner nations key findings thus far of our review, which is based on an examination of all available information, including information provided to us by UN members in response to our request in ref A. If partner nations have any last minute additional information, they should provide it as soon as possible (but no later than October 27) so that we may update the committee (by October 30) on the results of our review of tranche 3 of names pursuant to paragraph 25 of UNSCR 1822. Department further wishes to convey the following points: - the seriousness with which the USG is taking its obligations pursuant to resolution 1822; - our hope that the results of our review will demonstrate our resolve to ensure meaningful review of the sanctions list; - our commitment to ensure fairness and transparency in the implementation of sanctions; - our view that the comprehensive review of the sanctions list is not simply a de-listing exercise, but that the USG has taken this opportunity to thoroughly review our files and, to the best of our ability, ensure that the listings we continue to support remain appropriate; - our view that the 1267 sanctions regime and the Consolidated List are essential and dynamic tools in combating the threats posed by al Qaeda and the Taliban and serve as a means for achieving consensus on the nature of these threats and the identification of specific targets; - the fact that we anticipate requesting or supporting de-listing of names from the 1267 Consolidated List on a rolling basis as the review proceeds; STATE 00109494 002.2 OF 011 SUBJECT: UN 1267 (AL-QAIDA/TALIBAN) SANCTIONS: RESULTS OF USG REVIEW OF TRANCHE 3 NAMES PURSUANT TO PARAGRAPH 25 OF UNSCR 18 - the fact that the 1822 review process has provided a number of opportunities to strengthen narrative summaries and to provide more detailed identifiers for listings; - at this time, out of the 83 names circulated under tranche 3 that the USG originally sponsored or co-sponsored, the USG is considering sponsoring or co-sponsoring the delisting of 29 names (24 individuals, 5 entities) pending further consultation with the other co-sponsoring Member States. -------------- BACKGROUND -------------- ¶3. (U) In order to ensure that the sanctions under UNSCR 1267 are implemented as fairly and transparently as possible, the Council made several changes to the regime in resolution 1822, adopted in June 2008. These measures include: requiring states that request new listings to provide information that may be released to the public on the proposed party's association with al-Qaida or the Taliban; requiring the committee to make available on its website a narrative summary of the reasons for listing for each individual and entity on the Consolidated List; and strengthening the call on states to properly notify parties when they are listed for sanctions. The Council also required the Committee to review by June 2010 every entry on the Consolidated List at the time of the adoption of UNSCR 1822 (June 2008) to ensure that each entry on the list remains appropriate and is as accurate as possible. Furthermore, at the completion of this comprehensive review, the committee going forward now must review on an annual basis each entry that has not been reviewed in three or more years. ¶4. (U) The entire text of UNSCR 1822 can be reviewed in reftel, or easily accessed on-line via the UN 1267 Committee website, located at http://www.un.org/sc/committees/1267/index.sh tml. For ease of reference, however, text of paragraph 25, which mandates the committee comprehensively review each entry on the sanctions list at the time of adoption of resolution 1822, is: "25. (The Security Council...) "Directs the Committee to conduct a review of all names on the Consolidated List at the date of adoption of this resolution by June 30, 2010 in which the relevant names are circulated to the designating states and states of residence and/or citizenship, where known, pursuant to the procedures set forth in the Committee guidelines, in order to ensure the Consolidated List is as updated and accurate as possible and to confirm that listing remains appropriate;" -------------- ACTION REQUEST STATE 00109494 003.2 OF 011 ¶5. (U) All Action Addressees are requested to share as soon as possible at the highest appropriate level the results of our review pursuant to paragraph 25 of UNSCR 1822 for the third tranche of names circulated by the UN 1267 Committee Chairman. Inform partner nations that the USG views each case as unique, and that we consider a variety of factors in reaching a decision on whether to support maintaining a listing or to support delisting, including the nature of activities that led to the original listing, the adequacy of identifiers, the credibility of any information reporting the listed person,s death, and the nature of any additional reporting that becomes available on a listed individual or entity following that individual's/entity's listing. Action addressees are further requested to inform partner nations that: ¶6. (U) On May 29, 2009, the UN 1267 Committee chair circulated the third tranche of names to be reviewed by the committee. In tranche 3, out of a total of 129 names, the USG was responsible for reviewing the 83 names (49 individuals and 34 entities) for which it had sponsored or co-sponsored the listing. The USG has reviewed these 83 names pursuant to the factors outlined above, and is considering sponsoring or co-sponsoring the delisting of 29 names (24 individuals, 5 entities) pending further consultation with the other co-sponsoring Member States, from this tranche: ¶1. KHALAYLEH, Ahmad Fadil Nazal (UN Permanent Reference Number I.A.131.03). - Reportedly deceased as of 2006; however, the USG supports the maintaining the listing of the "Zarqawi Network" which is listed on the Consolidated List as an AKA for Al-Qaida in Iraq (QE.J.115.04). ¶2. NADA INTERNATIONAL ANSTALT (UN Permanent Reference Number QE.N.79.02) - After careful and detailed review and analysis of all available information, the USG has determined that it currently lacks information sufficient to conclude that NADA INTERNATIONAL ANSTALT continues to engage in the activities for which it was originally listed or other activities that would provide a basis for continued listing. Absent additional derogatory information from other Member States, the USG is considering supporting the removal of NADA INTERNATIONAL ANSTALT from the UNSCR 1267 Consolidated List. The USG reserves the option to resubmit it for listing should new information be found indicating that it continues to engage in the activities for which it was originally listed or in new activities that would justify listing. ¶3. Absent additional derogatory information from other Member States, the USG is considering supporting the removal of BA TAQWA FOR COMMERCE AND REAL ESTATE COMPANY LTD from the UNSCR 1267 Consolidated List. The USG reserves the option to resubmit it for listing should new information be found indicating that it continues to engage in the activities for which it was originally listed or in new activities that would justify listing. ¶4. AL-WADHANI, Habib Ben Ali Ben Said (UN Permanent Reference Number QI.A.78.02) - Reportedly deceased. ¶5. AL-JELASSI, Riadh Ben Belkassem Ben Mohammed (UN Permanent Reference Number QI.A.71.02) - After careful and detailed review and analysis of all available information, the USG has determined that it currently lacks information sufficient to conclude that AL-JELASSI continues to engage in the activities for which he was originally listed or other activities that would provide a basis for continued listing. Absent additional derogatory information from other Member States, the USG is considering supporting the removal of AL-JELASSI from the UNSCR 1267 Consolidated List. The USG reserves the option to resubmit him for listing should new information be found indicating that he continues to engage in the activities for which he was originally listed or in new activities that would justify listing. ¶6. AL-TLILI, Al Azhar Ben Mohammed Bel El-Abed (UN Permanent Reference Number QI.A.77.02) - After careful and detailed review and analysis of all available information, the USG has determined that it currently lacks information sufficient to conclude that AL-TLILI continues to engage in the activities for which he was originally listed or other activities that would provide a basis for continued listing. Absent additional derogatory information from other Member States, the USG is considering supporting the removal of AL-TLILI from the UNSCR 1267 Consolidated List. AL-RIHANI, Lofti Ben Abdul Hamid Ben Ali (UN Permanent Reference Number QI.A.145.03) - Reportedly deceased. ¶12. MSALAM, Fahid Mohammed Ally (UN Permanent Reference Number QI.M.34.01) - Reportedly deceased as of January 2009. ¶13. SWEDAN, Sheikh Ahmed Salim (UN Permanent Reference Number QI.S.35.01) - Reportedly deceased as of January 2009 ¶14. EL MAHFOUDI, Mohamed (UN Permanent Reference Number QI.E.175.04) - After careful and detailed review and analysis of all available information, the USG has determined that it currently lacks information sufficient to conclude that EL MAHFOUDI continues to engage in the activities for which he was originally listed or other activities that would provide a basis for continued listing. Absent additional derogatory information from other Member States, the USG is considering supporting the removal of EL MAHFOUDI from the UNSCR 1267 Consolidated List. The USG reserves the option to resubmit him for listing should new information be found indicating that he continues to engage in the activities for which he was originally listed or in new activities that would justify listing. ¶15. AL-TRABELSI, Chabaane Ben Mohamed Ben Mohamed (UN Permanent Reference Number QI.A.178.04) - After careful and detailed review and analysis of all available information, the USG has determined that it currently lacks information sufficient to conclude that AL-TRABELSI continues to engage in the activities for which he was originally listed or other activities that would provide a basis for continued listing. Absent additional derogatory information from other Member States, the USG is considering supporting the removal of AL-TRABELSI from the UNSCR 1267 Consolidated List. MZOUDI, Abdelghani (UN Permanent Reference Number QI.M.89.03) - After careful and detailed review and analysis of all available information, the USG has determined that it currently lacks information sufficient to conclude that MZOUDI continues to engage in the activities for which he was originally listed or other activities that would provide a basis for continued listing. Absent additional derogatory information from other Member States, the USG is considering supporting the removal of MZOUDI from the UNSCR 1267 Consolidated List. The USG reserves the option to resubmit him for listing should new information be found indicating that he continues to engage in the activities for which he was originally listed or in new activities that would justify listing. ¶17. AL-AYARI, Chileb Ben Mohamed Ben Mokhtar (UN Permanent Reference Number QI.A.93.03) - After careful and detailed review and analysis of all available information, the USG has determined that it currently lacks information sufficient to conclude that AL-AYARI continues to engage in the activities for which he was originally listed or other activities that would provide a basis for continued listing. Absent additional derogatory information from other Member States, the USG is considering supporting the removal of AL-AYARI from the UNSCR 1267 Consolidated List. DARRAJI, Kamal Ben Mohamed Ben Ahmed (UN Permanent Reference Number QI.D.174.04) - After careful and detailed review and analysis of all available information, the USG has determined that it currently lacks information sufficient to conclude that DARRAJI continues to engage in the activities for which he was originally listed or other activities that would provide a basis for continued listing. Absent additional derogatory information from other Member States, the USG is considering supporting the removal of DARRAJI from the UNSCR 1267 Consolidated List. The USG reserves the option to resubmit him for listing should new information be found indicating that he continues to engage in the activities for which he was originally listed or in new activities that would justify listing. ¶21. ABDELHEDI, Mohamed Ben Mohamed Ben Khalifa (UN Permanent Reference Number QI.A.173.04) - After careful and detailed review and analysis of all available information, the USG has determined that it currently lacks information sufficient to conclude that ABDELHEDI continues to engage in the activities for which he was originally listed or other activities that would provide a basis for continued listing. Absent additional derogatory information from other Member States, the USG is considering supporting the removal of ABDELHEDI from the UNSCR 1267 Consolidated List. The USG reserves the option to resubmit him for listing should new information be found indicating that he continues to engage in the activities for which he was originally listed or in new activities that would justify listing. ¶22. OUAZ, Najib (UN Permanent Reference Number QI.A.104.03) - After careful and detailed review and analysis of all available information, the USG has determined that it currently lacks information sufficient to conclude that OUAZ continues to engage in the activities for which he was originally listed or other activities that would provide a basis for continued listing. Absent additional derogatory information from other Member States, the USG is considering supporting the removal of OUAZ from the UNSCR 1267 Consolidated List. The USG reserves the option to resubmit him for listing should new information be found indicating that he continues to engage in the activities for which he was originally listed or in new activities that would justify listing. ¶23. AL-KADR (Khedr),Ahmad Sa'id (UN Permanent Reference Number QI.K.4.01) - Reportedly deceased as of 2003. STATE 00109494 008.2 OF 011 ¶24. (DEWEDAR) ATWAH, Muhsin Moussa Matwalli (UN Permanent Reference Number QI.A.24.01) - Reportedly deceased as of 2006. ¶25. EL SAYED, Abd El Kader Mahmoud Mohamed (UN Permanent Reference Number QI.E.65.02) - After careful and detailed review and analysis of all available information, the USG has determined that it currently lacks information sufficient to conclude that EL SAYED continues to engage in the activities for which he was originally listed or other activities that would provide a basis for continued listing. Absent additional derogatory information from other Member States, the USG is considering supporting the removal of EL SAYED from the UNSCR 1267 Consolidated List. The USG reserves the option to resubmit him for listing should new information be found indicating that he continues to engage in the activities for which he was originally listed or in new activities that would justify listing. ¶26. BASAYEV, Shamil Salmonvich (UN Permanent Reference Number QI.B.107.03) - Numerous open sources reports confirm Basayev,s death during a Russian counterterrorism operation. ¶27. ISLAMIC INTERNATIONAL BRIGADE (IIB) (UN Permanent Reference Number QE.I.99.03) - Group weakened after Basayev,s death and is now thought to be defunct. ¶28. SPECIAL PURPOSE ISLAMIC REGIMENT (SPIR) (UN Permanent Reference Number QE.S.101.03) - Group weakened after Basayev,s death and is now thought to be defunct. ¶29. RIYADUS-SALIKHIN RECONNAISSANCE AND SABOTAGE BATTALION OF CHECHEN MARTYRS (RSRSBCM) (UN Permanent Reference Number QE.R.100.03) - We have uncovered conflicting accounts of the operational capability of this group. The Russian government has declared vehemently that this group does not exist; however, they have claimed responsibility for multiple incidents over the past couple of years, and some as recently as August. Regardless, any link to al-Qa,ida is unlikely at this point. ¶7. (SBU) The BARAKAAT NETWORK: Posts should inform their Host Governments that the while the USG supports the removal of any verifiably defunct Barakaat entities, it does not support the removal of the entire organization and will consider the merits of removing each entity on a case-by-case basis. Posts should inform Host Governments that we support ongoing listing of the Barakaat Network based upon the networks association with UN 1267-listed Ali Jimale Ahmed, whose continued listing we support. ¶8. (SBU) Embassy Rome: In addition to sharing the information in paragraphs 5-7, Embassy Rome should inform the GOI that after reviewing the names (listed below) co-sponsored by the GOI and supported by the U.S., the USG does not have any STATE 00109494 009.2 OF 011 SUBJECT: UN 1267 (AL-QAIDA/TALIBAN) SANCTIONS: RESULTS OF USG REVIEW OF TRANCHE 3 NAMES PURSUANT TO PARAGRAPH 25 OF UNSCR 18 additional information to support retaining the listing of a number of these names. Embassy Rome should request the GOI for its views on each of the names (below) submitted by the GOI and ask whether the GOI will recommend retaining them on or removing them from the Consolidated List. If the GOI plans to recommend retaining these names on the Consolidated List, Embassy Rome should ask the GOI to provide any additional information it can share with the USG. Embassy Rome should inform the GOI that the USG would like to be in a position to support the GOI's position but should underscore to the GOI that absent additional information from the GOI, the USG is currently considering submitting these names to the Committee for removal from the Consolidated List. We would like to work with the GOI to address any differences in views on any of the names and welcome any additional information pertinent to the review of these 1267 listings that host government officials wish to provide. Embassy Rome should emphasize that we have a limited period of time in which to resolve any differences regarding the names and should request that the GOI inform the USG of its views on the names as soon as possible but request that it be no later than two weeks from receipt of this demarche: number 2-Nada International Anstalt, 3-BA Taqwa For Commerce and Real Estate Company Limited, 4-Name: Habib Ben Ali Ben Said Al-Wadhani, 5-Riadh Ben Belkassem Ben Mohamed Al-Jelassi, 6-Al-Azhar Ben Mohammed Ben El-Abed al-Tlili, 7-Samir Abd El Latif El Sayed Kishk, 11-Lofti Ben Abdul Hamid Ben Ali Al-Rihani, 14-Mohammed El Mahfoudi, 15-Mourad Bel Ali Ben Al-Basheer Al Trabelsi, 17-Chiheb Ben Mohamed Ben Mokhtar Al-Ayari, 18-Faouzi Ben Mohamed Ben Ahmed Al-Jendoubi, 19-Mohamed Amine Akli, 21-Mohamed Ben Mohamed Ben Khalifa Abdelhedi, 23-Ahmed Said Zaki Khedr, 24-Muhsin Moussa Matwalli Atwah Dewedar, 25-Abd El Kader Mahmoud Mohamed El Sayed, Kamal Ben Maoeldi Ben Hassan Al-Hamaroui (QI.D.174.04) and Najib Ben Mohamed Ben Salem Al-Waz (QI.A.104.03). ¶9. (SBU) Embassy Moscow: In addition to sharing the information in paragraphs 5-7, Embassy Moscow should take this opportunity to encourage the Government of Russia (GOR) to provide or update bio-identifiers for the 39 Taliban names it is reviewing in tranche 3, either as the designating state (for 16 Taliban individuals) or co-sponsor (for 23 Taliban individuals),and to provide as much information as possible to support maintenance of those names on the 1267 Consolidated List, or -- absent such information -- to support de-listing. Embassy Moscow should underscore to the GOR that most of these listings lack any information on the listed person's activities since 2001, and the absence of adequate bio-identifiers for the vast majority of the Taliban names on the Consolidated List makes implementation of sanctions against these individuals virtually impossible. Without additional updates and bio-identifiers, our view is that many of these entries should be de-listed. Maintaining these entries on the list without adequate supporting STATE 00109494 010.2 OF 011 SUBJECT: UN 1267 (AL-QAIDA/TALIBAN) SANCTIONS: RESULTS OF USG REVIEW OF TRANCHE 3 NAMES PURSUANT TO PARAGRAPH 25 OF UNSCR 18 information will severely undermine the credibility of the Consolidated List -- and of the 1267 Committee's review pursuant to paragraph 25 of UNSCR 1822. Embassy Moscow should further inform the GOR that we are currently considering delisting one additional individual and the additional entities from the 1267 Consolidated List. We would welcome any additional information pertinent to the review of these 1267 listings that host government officials wish to provide. The names currently being considered for delisting of interest to Russia include: number 26-Shamil Salmonvich Basayev, 27-Islamic International Brigade (IIB),28-Special Purpose Islamic Regiment (SPIR),and 29-Riyadus-Salikhin Reconnaissance and Sabotage Battalion of Chechen Martyrs (RSRSBCM). ¶10. (SBU) Embassies Jakarta, Kuala Lumpur, Manila, Singapore and Canberra: Please note that the key names for you in paragraph 6 above are: 8-al-Ghozi, 9-Haq(Muhklas),and 10-Samudra, all deceased. We anticipate your host governments will have no additional info to provide, and no objections to our plans to propose delisting of these three names. ¶11. (SBU) Embassy Beijing: Please be aware (per reftel para 16) that China joined the U.S. and several other countries in co-sponsoring the original listing of three organizations in paragraph 6 above that the U.S. is considering for delisting: 27-IIB, 28-SPIR, and 29-RSRSBCM. Therefore, Chinese authorities may have a particular interest in those entities. ¶12. (SBU) Embassy Berlin: Please be aware that German officials may have a particular interest in the fact that we are considering supporting delisting, pending further discussion with co-sponsors or other interested partners, of two individuals of interest to Germany: 16-Abdelghani Mzoudi and 1-Ahmad Fadil Nazal Al-Khalayleh. ¶13. (SBU) Embassy Rabat: Please be aware that Moroccan officials may have particular interest in the fact that we are considering supporting delisting, pending further discussion with co-sponsors or other interested partners, of 16-Abdelghani Mzoudi. ¶14. (SBU) Embassies Nairobi and Islamabad: Please be aware that Kenyan officials may have particular interest in the fact that we are considering supporting delisting, pending further discussion with co-sponsors or other interested partners, of two individuals of interest to Kenya: 12-Fahid Mohammed Ally Msalam and 13-Sheik Ahmed Salim Swedan. ¶15.
