1. (U) This is an action request -- see para 3.
2. (S) According to Privy Council Office Director of
Operations Matthew Levin, the government would have to file
an appeal to the Federal Court by June 19 should it decide to
contest the court's order to repatriate Abousfian Abdelrazik
from Sudan within thirty days (ref a). Levin indicated that
the policy recommendation from the Department of Foreign
Affairs and International Trade had been to abide by the
court order and to arrange for Abdelrazik's return in time
for the required July 7 appearance in court, but he predicted
that the ultimate political decision by the Prime Minister's
Office would be to file the appeal, as the government had
done with a similar court order to seek the repatriation of
Canadian detainee in Guantanamo Bay Omar Khadr (ref b).
PolMinCouns reiterated substance of 2008 guidance on Canadian
actions in this case (ref c) and promised to ask for an
update, just in case the decision is in favor of his
repatriation.
