1. Unauthorized disclosure of the information provided below is
prohibited by Section 12(c) of the Export Administration Act.
2. On January 15, 2009, Export Control Officer (ECO) Paul Cushman
and FSN Shailendra Srivastava conducted a Post-Shipment Verification
(PSV) at Allengers Medical Systems Limited (ALLENGERS) in
Chandigarh.
3. BIS requested a PSV at ALLENGERS, located at Bhankarpur on
Mubarakpur Road, District Mohali, Chandigarh. ALLENGERS was listed
as the ultimate consignee for twenty-six GP-12B spark gaps
manufactured by Perkin-Elmer Optoelectronics of Salem,
Massachusetts. Export License: D389222. ECCN: 3A228.
4. ECO and FSN Srivastava met with Mr. Sanjeev Marjara, Director
(Technical),Mr. R.S. Kanwar, Executive Director, and Ms. Roohi
Puri, Manager, in Marjara's office.
5. ALLENGERS representatives were familiar with BIS regulations.
However, this was the first visit by BIS officials to their
facility. Marjara provided copies of the following documents
relating to this transaction: ALLENGERS Purchase Order, Perkin-Elmer
Acknowledgement, Perkin-Elmer Invoice, Air Waybill, a receipt for
duties paid to the Indian Customs Authority, a copy of Export
License D389222, and the End-Use Statement (BIS-711). Marjara
acknowledged that he understood, had complied with, and would
continue to comply with the license conditions.
6. Puri explained that the spark gaps were received in two lots, ten
in March 2008 and the remaining sixteen in April 2008.
7. Marjara confirmed the stated end-use. He explained that the
spark gap is incorporated in an Extracorporeal Shock Wave
Lithotripter. It is used to generate a spark in a reflector filled
with water. This instantly converts the water to vapor and produces
a high intensity pressure wave which is directed at kidney stones in
order to pulverize them without injuring the patient.
8. After the meeting, the BIS team was given an extensive tour of
the ALLENGERS facility. ECO physically verified 9 spark gaps stored
in the warehouse, another 5 in the production department and one
more installed in a lithotripter on display in their product
showroom. Marjara explained that the remaining 11 spark gaps were
installed in lithotripters already sold and shipped to various
hospitals. He provided end-use statements from the eleven hospitals
to support these transfers.
9. Established in 1987, Allengers Medical Systems Limited is a
manufacturer of medical diagnostic equipment including a wide range
of X-ray machines (dental, chest, orthopedic, mammography, digital
subtraction angiography, portable, and satellite linked) as well as
lithotripters. ALLENGERS is an ISO 9001 certified company with
customers in over 50 countries throughout the developing world.
ALLENGERS has approximately 550 employees. The facility operates
around the clock and a private security guard is always on duty.
10. Recommendation: At the time of this visit, Allengers Medical
Systems Limited appeared to be a reliable recipient of this
controlled technology. The items on check were physically verified
and were being used in a manner consistent with the Export
Administration Regulations.
