1. (C) Kofi Annann recently called me to review the state of
play with respect to the reform agenda. He wanted to touch
base before two coalition representatives visit him in Geneva
July 2 (Minister of Justice Mutula Kilonzo and Minister of
Lands James Orengo).


2. (C) Annan said he recently spoke with President Kibaki and
Prime Minister Odinga to urge action on reforms. He
emphasized to them the growing impatience of the
international community to see results. Annan said he
received assurances, with few specifics.


3. (C) Annan is particularly focused on establishment of the
Special Tribunal, since he has indicated he will give the
Waki list of suspected perpetrators of post-election violence
to the International Criminal Court (ICC) by the end of
August if the coalition government has not taken action by
then. Annan referred to speculation that the coaltiion
government may try to establish a Tribunal under existing
legal and judicial structure- since there is concern that
Parliament may again reject a constitutional amendment to
establish an independent Special Tribunal. Annan commented
that establishment of a Tribunal under existing corrupt
structure would not be credible. If the coaltion government
proceeds to do this he will turn over the list to the ICC.


4. (C) Annan said that he appreciates the need to return to
Kenya soon, but wants to do so with a clear objective. He is
thinking about holding in KENYA a public forum similar to
that which he convened in Geneva in March (see reftel).


5. (C) Annan said he will remain closely involved in KENYA in
order to push forward the reform agenda.
