1. (S) In response to reftel demarche, MFA provided Embassy
with the following response in both Ukrainian and English.

-- In the spirit of our nonproliferation partnership and in
response to the request of the American Side, we would like
to inform you the following.
-- State Enterprise "Arsenal" did not request State Service
of Export Control of Ukraine a license/permit to conduct
negotiations with a purpose of signing foreign contracts or
to perform international transfers of UGT-A high accuracy
gyrotheodolite to China.
-- State Enterprise Plant "Arsenal" did not have any
relations with China's Wuhan Sanjiang Import-Export
Corporation nor made any supplies to it, and does not
exercise any cooperation with Chinese companies.
-- In July 2008, State Enterprise Plant "Arsenal" did not
hold any negotiations or make any shipments to China.
-- Regarding the alleged attempt of a weapons broker known as
Arms Trade Pakistan to procure a variety of guidance and
control equipment, we would like to inform that the State
Company "Ukrspetsexport" did not conduct any negotiations on
this matter with the said broker, neither we have any
information as for stay or visits of its representatives to
Ukraine.
-- Transfers of military and dual use goods to China are
performed in accordance with the Ukrainian export control
legislation and international obligations in the field of
nonproliferation with absolute adherence to the MTCR
Guidelines. Moreover, official governmental guarantees of
the Chinese party not to use supplied goods in programs of
WMD production or means of its delivery are obligatory.
