TO UNFREEZE ASSETS OF UN 1267 DESIGNEE HAMAD AL-ALI
1. (SBU) Kuwaiti press reported on January 26 that
Kuwait's Court of First Instance had ruled in favor of
releasing the assets of UN 1267 Designee Hamed Al-Ali.
Al-Ali's assets were frozen by the Government of Kuwait (GOK)
in July 2008, following the January 16, 2008 UN 1267
designation of Al-Ali and two other Kuwait-based Terrorist
Financiers. According to the press report, Al-Ali filed a
lawsuit against the Central Bank claiming the freezing of his
assets were unwarranted. (Note: Per the request of the GOK
and pursuant to UN resolution 1452, the UN Security Council
had previously approved the release of Al-Ali's salary. End
Note.)
2. (SBU) Post contacted the Ministry of Foreign Affairs
(MFA),the Ministry of Justice (MOJ) and the Central Bank to
request further information about the case and next steps.
Musaed Al-Thuwaikh, an official at MFA's Follow-up
Department, said he would look into the regulations, but
anticipated that the GOK would appeal the ruling. The GOK
apparently has 30 days to appeal. Talal AlSayegh, Deputy
Manager of the On-Site Supervision Department at Kuwait's
Central Bank confirmed that Al-Ali's account would remain
frozen until an official notification from MFA has been
received.
