1. On May 28 Australian Customs and Border Protection Service
informed Embassy that it has initiated an investigation into
alleged dumping of linear low density polyethelyne (LLDP)
from the US and Canada; the decision was also published in
the May 28 edition of national newspaper The Australian. Per
Australian Customs Dumping Notice No. 2009/12 (emailed
separately to State, USTR, and DOC/ITA),the investigation,
brought upon complaint by Qenos Pty Ltd, described as
Australia's only manufacturer of LLDP, will cover the period
January 1 2008 to March 31 2009.


2. Timing of the investigation is mandated by legislation,
and is described in greater detail in the Notice 2009/12.
Interested parties may lodge submissions by July 7. Customs
will issue a statement of essential facts by September 15,
with interested parties able to respond within 20 days. A
recommendation will be made to the Home Affairs minister by
October 30.


3. Comment: This appears to be the first new anti-dumping
investigation against a product from the United States since
the US-Australia FTA went into effect on January 1, 2005.
