1. On November 25 Australian Customs and Border Protection
Service (CBPS) informed Embassy that it has terminated an
investigation into alleged dumping of linear low density
polyethelyne (LLDP) from the U.S. and Canada. The decision
was also published in the November 25 edition of national
newspaper The Australian.
2. Per Australian Customs Dumping Notice No. 2009/41 (emailed
separately to State, USTR, and DOC/ITA),CBPS terminated the
investigation in a November 20 CBPS decision. The
investigation had been initiated in May 2009 upon complaint
by Qenos Pty Ltd, described as Australia's only manufacturer
of LLDP. In summary, CBPS determined that while some form of
"dumping has or may be taking place, the injury to Australian
industry that has or may be caused by that dumping is
negligible." The notice provides further details on the
termination, including the Qenos' right to apply for a review
of the decision within 30 days.
