1. (SBU) As discussed Ref A, the European Commission designated
Abdul Haq (Ref B) on April 25. Furthermore, the EU is progressing
in revising the law implementing UNSCR 1267 Al Qaida and Taliban
sanctions EU-wide (Ref C). Contacts indicate that some EU Member
States may be favoring an overhaul of the Commission proposal to
bring the UN 1267 designations procedure under the umbrella of the
EU's autonomous terrorism designations procedure known as "Common
Position 931 Working Group" (FKA "Clearinghouse," and comparable to
the UNSCR 1373 domestic designations track). A final decision may
not be reached before the fall or winter. EU capitals are still
studying the implications of the proposed legislative changes, which
would institutionalize the procedural reforms taken following the
September 2008 EU court annulment of the Kadi and Al Barakaat
designations.
