MANAS TRANSIT CENTER AGREEMENTS ENTER INTO FORCE

(SBU) On July 11, the Charge and Kyrgyz Foreign Minister Kadyrbek Sarbayev met and exchanged diplomatic notes in order to bring the two Manas-related agreements into force. On July 13, the Foreign Ministry sent another diplomatic note confirming that the Agreement for Cooperation came into force on July 11, and that the Agreement regarding the Transit Center would come into force on July 14. The texts of the two July 11 diplomatic notes are repeated below. The text of the July 13 diplomatic note will be sent septel. ¶2. (SBU) In the July 11 exchange, FM Sarbayev delivered Kyrgyz Diplomatic Note #011-11/1203, which we have translated below: (Complimentary opening) On July 2, 2009, the Kyrgyz Republic adopted Law #199, which ratifies the Agreement for Cooperation between the Government of the Kyrgyz Republic and the Government of the United States of America, as well as the Agreement between the Government of the Kyrgyz Republic and the Government of the United States of America regarding the Transit Center at Manas International Airport and any Related Facilities/Real Estate. In this regard, the Ministry wishes to inform the Embassy that in accordance to Article 11 of the Agreement on Cooperation between the Government of the Kyrgyz Republic and the Government of the United States of America, the Kyrgyz Side has completed intrastate procedures necessary for entering this Agreement into force. Therefore, this Agreement shall enter into force on the date of receipt of the last note in the process of exchanging diplomatic notes between the parties, where each party confirms the completion of intrastate procedures necessary for entering this Agreement into force. The Ministry also wishes to inform the Embassy that in accordance to Article 10 of the Agreement between the Government of the Kyrgyz Republic and the Government of the United States of America regarding the Transit Center at Manas International Airport and any Related Facilities/Real Estate, the Kyrgyz Side has completed intrastate procedures necessary for entering this Agreement into force. Therefore, this Agreement shall enter into force on the date of receipt of the last note in the process of exchanging diplomatic notes between the parties, where each party confirms the completion of intrastate procedures necessary for entering this Agreement into force, or on July 14, 2009, whichever is later. (Complimentary closing) ¶3. (SBU) Following receipt of the Kyrgyz diplomatic note, the Embassy responded with Diplomatic Note #254, dated July ¶11. The text of the U.S. diplomatic note is repeated below: (Begin text) The Embassy of the United States of America presents its compliments to the Ministry of Foreign Affairs of the Government of the Kyrgyz Republic and has the honor to acknowledge receipt of Diplomatic Note No. 011-11/1203 dated 11 July, 2009 from the Ministry of Foreign Affairs of the Kyrgyz Republic providing notification that in accordance to the Law of the Kyrgyz Republic #199 dated 2 July, 2009 the Kyrgyz Republic has completed intrastate procedures for the entry into force of the Agreement for Cooperation between the Government of the United States of America and the Government of the Kyrgyz Republic and the Agreement between the Government of the United States of America and the Government of the Kyrgyz Republic Regarding the Transit Center at Manas International Airport and any Related Facilities/Real Estate. BISHKEK 00000745 002.2 OF 002 Thus, the Embassy wishes to inform the Ministry of Foreign Affairs of the Kyrgyz Republic that the American side (or the United States of America) in accordance to Article 11 of the Agreement for Cooperation between the Government of the Kyrgyz Republic and the Government of the United States of America, has completed intrastate procedures necessary to bring this Agreement into force. Therefore, this Agreement shall enter into force on the date of this Note. The Embassy also wishes to inform the Ministry of Foreign Affairs of the Kyrgyz Republic that the American side (or the United States of America) in accordance to the Article 10 of the Agreement between the Government of the Kyrgyz Republic and the Government of the United States of America Regarding the Transit Center at Manas International Airport and any Related Facilities/Real Estate, has completed intrastate procedures necessary to bring this Agreement into forces. Therefore, this Agreement shall enter into force on the date of this Note or July 14, 2009, whichever is later. (Complimentary closing) ¶4. (SBU) As indicated above, Embassy will transmit the text of the July 13 Kyrgyz diplomatic note separately. Embassy will also transmit the text of the diplomatic note on the development fund. Embassy will also pouch to the Department the original July 11 Kyrgyz note and a certified copy of the July 11 U.S. note. LITZENBERGER
