SUBJECT: USG WORKSHOP FOR MILITARY JUDGES PROMOTES PROSECUTING AND
ADJUDICATING TERRORISM FINANCING CASES

1. (U) The U.S. Department of Justice's Office of Overseas
Prosecutorial Development and Training (OPDAT) and U.S. Treasury's
Office of Technical Assistance (OTA) recently delivered two, two-day
workshops in Amman on "Prosecuting and Adjudicating Terrorism
Finance Cases" to 38 Jordanian State Security Court judges. The
August 10-13, 2009, pair of workshops was conducted under the
support of the Jordan Armed Forces Military Judiciary Directorate
and funded by OPDAT and OTA.

2. (U) The workshops were designed to provide Jordanian judges with
insight into the complexities of investigating and prosecuting
terrorism finance cases to improve the adjudication of criminal
charges in light of Jordan's Law No. 55 of 2006, the Anti Terrorism
Law.


3. (U) The seminar agenda included presentations on:

- Benefits of Anti-Terrorism Finance Laws

- Jordan's Anti-Terrorism Finance Regime Structure and Legal
Framework

- Introduction to Terrorism Financing Concepts, Methods and Trends

- U.S. Experience in Terrorism Financing Prosecutions

- Terrorism Financing Investigations

- Conducting Terrorism Financing Interviews

- Task Force Development

- Safeguarding Charities

- Foreign Requests for Judicial Assistance

- Round Table Discussion on Jordan's State Security Court and the
prosecution and adjudication of terrorism financing case.


4. (U) The OPDAT Regional Legal Advisor - Abu Dhabi and the OTA
Resident Economic Crimes Advisor - Amman were joined by Assistant
U.S. Attorneys from Washington and Florida, the Legatt - Amman, and
a U.S. District Judge from the District of Nevada in presenting the
workshops.


6. (U) Military Judiciary Judges from the State Security Court
(SSC) comprised the 38 participants. Participants particularly
appreciated the inclusion of sitting U.S. jurists, prosecutors, and
investigators who have had experience in the topic of terrorist
financing as presenters in the workshops.


7. (SBU) Although Article 3 of Law No. 55 of 2006 criminalizes
giving, raising, or managing funds, directly or indirectly, to be
used in committing a terrorist act, the consensus of the attendees
was that several changes to current Jordanian legislation are
necessary to effectively investigate and prosecute the financing of
terrorist groups or organizations.


8. (SBU) In the May 2009 plenary session of the Middle East and
North Africa Financial Action Task Force (MENAFATF),a mutual
evaluation report of Jordan's compliance with the 40+9
recommendations of the Financial Action Task Force (FATF) revealed
that Jordan is only partially compliant with Special Recommendation
II - Criminalization of Terrorist Financing. Based on this finding
and assessment of commentary in these workshops, post will work with
the GOJ to draft and affect new legislation which meets this
important international standard.
