(SBU) Conoff delivered reftel demarche on the proposal to exchange terrorist screening information pursuant to HSPD-6 to Maiko Fujiwara, MOFA, International Counter-Terrorism Coordination Division, Foreign Policy Bureau. ¶2. (SBU) Fujiwara thanked Conoff for the information and noted the GOJ was still waiting for a response to an extensive list of questions on HSPD-6 submitted to the USG in July 2008. ¶3. (SBU) Fujiwara stated there are several agencies within the GOJ that must agree to the exchange and reaching an agreement may be difficult because of concerns over privacy law violations. As an example, she cited the fact that GOJ agencies were not currently sharing terrorist screening information with each other because of the sensitivity to privacy laws. ¶4. (SBU) Fujiwara indicated that if the USG provided an example of an MOU concluded with a country having similar privacy concerns, it could help move the discussion forward. She also had concerns about accessing the information, how many names the GOJ could access and how many names they would have to provide. Conoff replied the MOU did not have to be comprehensive with all GOJ interlocutors and that just starting negotiations could be helpful in resolving any questions on specific points. ¶5.
