(U) This is an action request; see paras 2 - 4. -------------- ACTION REQUEST -------------- ¶2. (SBU) Embassy Kigali is requested to thank the Government of Rwanda (GOR) again for their extraordinary effort to produce a comprehensive submission of FDLR targets for inclusion on the consolidated travel ban and asset freeze list maintained by the UN Security Council Committee established pursuant to resolution 1533 (2004) concerning the Democratic Republic of the Congo (DRC Sanctions Committee). Please explain to the GOR that we have reviewed its list of proposed targets in great detail, along with other information, and we have developed a list of FDLR targets, some of whom were included on the GOR's list and others who were identified by other sources, that we hope to be able to support with sufficient identifying and other information for Member States to effectively implement the sanctions. Please also explain that, in order to implement UN sanctions, the U.S. Government must be able to meet U.S. domestic legal requirements, which require adequate identifying information and information demonstrating that each target meets the listing criteria. Unfortunately, we have not been able to meet those standards on some of the targets proposed by the Government of Rwanda. ¶3. (SBU) Embassy Kigali is also requested to provide citizenship information for each target listed in para 6 and transmit response via a standalone UNCLASSIFIED cable. ¶4. (SBU) Finally, Embassy Kigali is to request additional information, and clarification in cases of discrepancy (as noted in para 6),from the Government of Rwanda on the targets in para 6. The information needed is: a) any additional available identifiers and b) information demonstrating that targets meet the criteria for designation under UN Security Council resolution 1807 (2008). See para 8 for requested identifiers and para 9 for listing criteria. -------------- STRATEGIC OBJECTIVE -------------- ¶5. (SBU) In May, the Government of Rwanda (GOR) submitted nineteen FDLR targets for listing by the DRC Sanctions Committee. The U.S. placed a hold on the submission by the GOR in order to evaluate the information available for each proposed target. In order to be responsive to the GOR, we need to lift our hold and indicate our objection to or support for the listing by the DRC Sanctions Committee of each of the GOR proposed targets. -------------- IDENTIFIERS -------------- ¶8. (U) Identifiers Requested for Designations For each target, we would like to compile the following types of identifier data: - Name - Aliases and AKAs - Passport number(s) and country of issuance - Citizenship - Date of Birth (ideally, a precise date; if not, the year of birth) - Place of birth - Current location - Professional title -------------- UNSC DRC SANCTIONS COMMITTEE LISTING CRITERIA -------------- ¶9. (U) Persons or entities proposed for listing must meet one or more of the listing criteria from operative paragraph 13 of UNSC Resolution 1807 (2008): a) Persons or entities acting in violation of the arms embargo with respect to non-governmental entities and individuals in the DRC; b) Political and military leaders of foreign armed groups operating in the Democratic Republic of the Congo (DRC) who impede the disarmament and the voluntary repatriation or resettlement of combatants belonging to those groups; c) Political and military leaders of Congolese militias receiving support from outside the DRC, who impede the participation of their combatants in disarmament, demobilization, and reintegration processes; d) Political and military leaders operating in the DRC and recruiting or using children in armed conflicts in violation of applicable international law; and, e) Individuals operating in the DRC and committing serious violations of international law involving the targeting of children or women in situations of armed conflict, including killing and maiming, sexual violence, abduction and forced displacement.
