(U) This is an action request. Please see paragraph two. -------------- SUMMARY -------------- ¶2. (U) The Department requests that post deliver as soon as possible two nonpapers to the UAE in preparation for the Counterproliferation Task Force Meeting scheduled for February 25. -------------- OBJECTIVE -------------- ¶3. (S) The two nonpapers attached below have been cleared by the interagency to pass to the UAEG in advance of the upcoming US-UAE Counterproliferation Task Force Meeting scheduled for 25 February in Abu Dhabi. It is important that we prompt UAEG thinking on these issues prior to the CTF meeting. Department will transmit training plan mentioned in the first nonpaper, which was first sent via cable in July 2007 (reftel),via UNCLASS email. Papers should be distributed to UAE participants in preparation for the CTF in the manner post deems most effective. The Department will provide post with word document copies of the two attached documents by email. -------------- NONPAPERS -------------- ¶4. BEGIN FIRST SECRET/REL UAE NON-PAPER: Non Paper on the Status of Proliferation-Related Interdictions, Companies, and People We appreciate the cooperation between our two countries in confronting the proliferation of weapons of mass destruction and in trying to prevent the spread of weapons and materials that are being used to kill coalition forces and innocent Iraqi civilians. We also applaud your efforts in passing an export control law. Over the last year, you have stopped several shipments at our request that were going to Iran in violation of UNSCRs. We wanted to express our appreciation for these efforts. We know that in many cases we were only able to give you very short notice of the arrival and we appreciate your responsiveness. We would welcome your thoughts on how to improve information flow in both directions. We want to assure you that we focus our efforts on other transit countries and on the countries originating the goods. Unfortunately, due to the nature of the information, we do not always have enough advance warning to be able to do that 
and, given your location, many of these shipments transit your ports. On a broader note, we would welcome a discussion on how we can work together to develop a better system to prevent transshipments of items through your ports. We would like to give you an update on our efforts to have shipments recalled and would like to hear how your efforts and investigations are proceeding. We would also like to reiterate our request for access to the goods for our experts so that they might be able to develop more information to assist in your investigations. We hope as well to discuss various aspects of your export control law and we have attached a list of questions for discussion during the CTF meeting on February 25. As you move toward implementation of your export control law, we would also like to offer export control training. In particular we would like to discuss the export control training plan that we provided you in June 2007. For the sake of our discussion, we are attaching a list of interdictions, companies, and individuals that we have discussed either during CTF meetings or within the overall counterproliferation cooperation framework. We want to discuss the status of these cases in more detail. We understand, however, that implementing a law can be a challenge and we welcome a discussion on the status of your efforts on implementation. Questions for the UAE: ¶1. When will the UAE issue implementing regulations? ¶2. Does the UAE have questions or concerns regarding the implementing regulations that it would like to discuss with U.S. experts? ¶3. Will the implementing regulations be published? ¶4. When will a Chief of the Executive Agency of the Strategic Commodities Control Committee be named and have Committee Staff been selected? ¶5. What will the responsibilities be for the organizations that will comprise the Strategic Commodities Control Committee? ¶6. Will the UAE adopt the 2007 EU control list which covers all four multilateral control regimes? If yes, when? ¶7. How will the law deal with items not on control lists? ¶8. Who will enforce the law and how will enforcement be coordinated among all UAE law enforcement authorities? ¶9. How will the UAE educate industry on the provisions of the export control law? ¶10. How does the law provide authority to freeze financial assets related to the financing of proliferation-related exports or transshipments?
