(U) On April 3, post received a copy of the March 10 judicial decision of the ad interim 12th Justice of the Peace Mario Mardoqueo Menjivar Miranda, regarding the USG request for the extradition of Jose Marvin MARTINEZ. Justice Mardoqueo affirmed Martinez's provisional arrest order for the purpose of extradition. ¶2. (U) Justice Mardoqueo also granted three working days to the parties, once they have been summoned, to express their positions on the US extradition request. The GOES has not issued a formal response to this decision. ¶3. (U) MARTINEZ was arrested in Sonsonate, El Salvador on January 11, 2008 based on a US extradition request. A January 16 judicial decision affirmed the seizure of several items in the fugitive's possession at the time of the arrest. GLAZER
