1. Unauthorized disclosure of the information provided below is
prohibited by Section 12(c) of the Export Administration Act.
2. On November 25, 2008, Export Control Officer (ECO) Paul Cushman
and FSN Shailendra Srivastava conducted a Post-Shipment Verification
(PSV) at Tehri Hydro Development Corporation Limited (THDC),Tehri
Garhwal.
3. BIS requested a PSV at THDC located at Tehri Garhwal in
Uttranchal. THDC was listed as the ultimate consignee for one
Thermal Imaging Camera manufactured by Electrophysics Corporation of
Fairfield, New Jersey. Export License: D360022. ECCN: 6A003.
4. ECO and FSN Srivastava met with THDC representatives R.K. Chawla,
General Manager, A.K. Giliai, Senior Manager, and S. Krishna,
Engineer, and Mr. T.S. Saini, Manager, Bharat Heavy Electricals
Limited (BHEL). Mr. Randhir Jaiswal, Deputy Secretary, Ministry of
External Affairs, arranged and was present at the meeting.
5. THDC representatives were not familiar with BIS regulations and
this was the first visit by BIS officials to their facility. Saini
provided copies of the following documents relating to this
transaction: BHEL Purchase Order, Emerson Invoice, Emerson Packing
List, and the Delivery Challan. Saini stated that Electrophysics
did not provide the BIS license conditions to THDC. ECO provided
Saini with a copy of the license conditions which he reviewed. He
confirmed that THDC had complied with them and would continue to do
so.
6. The meeting was held in a conference room at the Koteshwar Hydro
Electric Project site which is a new dam under construction
down-river from the Tehri Dam. This plant will have the capacity to
generate 400 MW of electricity. He confirmed the stated end-use,
explaining that the camera will be used to detect faults in power
generation equipment yet to be installed at the dam.
7. After the meeting, the BIS team was given a tour of the facility.
ECO physically verified the camera's serial number as 32332. The
camera, still in the original shipping container, is stored in a
warehouse pending completion of the project. Round-the-clock
security is provided by GOI's Central Industrial Security Force.
8. Established in 1988, Tehri Hydro Development Corporation is a
joint venture between the governments of India and Uttar Pradesh to
generate electricity and control the regional water supply.
9. Recommendation: At the time of this visit, Tehri Hydro
Development Corporation appeared to be a reliable recipient of this
controlled technology. The item on check was physically verified
and all indications are that it will be used in a manner consistent
with the Export Administration Regulations.
