Unauthorized disclosure of the information provided below is prohibited by Section 12(c) of the Export Administration Act. ¶2. On September 8, 2008, Export Control Officer (ECO) Paul Cushman and FSN Shailendra Srivastava conducted a Post-Shipment Verification (PSV) at Mysore Thermo Electric Limited (MTEL) in Bangalore. ¶3. BIS requested a PSV at MTEL, located at Peenya Industrial Area Phase III, Bangalore. MTEL was listed as the ultimate consignee for one PICO Helium Leak Detector manufactured by MKS Instruments of Methuen, Massachusetts. Export License: No License Required. ¶4. ECO and FSN Srivastava met with Mr. Mahendra Kumar, Vice President - Marketing, Mr. R. Balraj, Chief Manager - Infrastructure Sales, and Mr. B.M. Nanda Kumar, Chief Material Manager. ¶5. MTEL representatives were not familiar with BIS regulations and this was the first visit by BIS officials to their facility. Balraj provided copies of the following documents relating to this transaction: MKS Invoice, MTEL Purchase Order, MKS Packing List, Air Waybill, and a receipt for duties paid to the Indian Customs Authority. ¶6. This meeting was held in the MTEL conference room. Balraj confirmed the stated end-use. He explained that the device is used to check for gas leakage at the conclusion of the battery manufacturing process. ¶7. After the meeting, the BIS team was given a tour of the MTEL facility. ECO physically verified the PICO Helium Leak Detector's serial number as 01XX08-016251108 and the model number as MSVAHE260000 (MKS PICO MASS SPEC LEAK DETECTOR). The device is secured in a locking cabinet in the MTEL production department and only authorized personnel have access to it. ¶8. Established in 1969, Mysore Thermo Electric Limited is an industrial battery manufacturer with 70 employees. MTEL is an approved supplier to Indian Railways. A roving security guard is on duty at the facility 24/365. ¶9. Recommendation: At the time of this visit, Mysore Thermal Electric Limited appeared to be a reliable recipient of this controlled technology.
