SUBJECT: Indonesia - Delivery of BEP MOU Response

1.(SBU) On May 22, we delivered the U.S. response to the Indonesian
Bioengagement Program Memorandum of Understanding (MOU) April
counter draft and accompanying cover letter to Desra Percaya,
Director for International Security and Disarmament, Ministry of
Foreign Affairs per instructions in reftel A.
2.(SBU) Percaya confirmed that Indonesia considers the document to
be legally binding, regardless of whether the word "will" or "shall"
is used. Percaya also confirmed that the Government of Indonesia has
authority under its law to grant the tax exemptions called for in
the agreement.
3.(SBU) Percaya noted that he needs time to inform other Indonesian
agencies and will request a quick turnaround, with the hopes for a
MOU signing in June.
