Reasons: 1.4(b) and (d). ¶1. (U) This is JCIC-XXXII-011. -------------- SUMMARY -------------- ¶2. (S) A Working Group Meeting on the issue of Elimination of Solid Rocket Motor Cases for First Stages of SS-24 (Ukrainian issue) was held at the U.S. Mission on July 21, ¶2008. All Parties, except Belarus, were represented. The Parties continued the discussion from the previous Heads of Delegation meeting (Ref A) on the Ukrainian proposal to move toward agreement on alternative elimination procedures for SS-24 ICBM solid rocket motor (SRM) cases. The U.S. Delegation explained that the U.S. proposal (Ref A) consisted of a JCIC Agreement which would add specific provisions in the Conversion or Elimination (C or E) Protocol that would permit the Parties to agree on alternate procedures for elimination of SRM cases that have had the propellant washed out of the motor case and residual fuel burned out. Specific procedures would be contained in a JCIC Joint Statement. The new procedures would be added to those contained in the C or E Protocol, which currently calls for the SRM cases to be eliminated by explosive detonation, crushing, flattening or cutting into two equal pieces. ¶3. (S) The Russian Delegation explained that its proposal provided specific language for the draft agreement which would have the effect of expanding the proposal to the elimination of SRM cases for any type of mobile missile. The Ukrainian delegation said it could support either formulation. ¶4. (S) The U.S. Delegation explained that it could not support the expansion proposed by the Russian Delegation. Resolution of this issue needed to be narrowly focused for the Ukrainian SS-24 SRM cases. The delegations agreed to review the draft texts proposed by the three delegations and study the alternate formulations and take up the discussion at a subsequent meeting. -------------- SS-24 ELIMINATION: CALM BEFORE THE STORM -------------- ¶5. (S) Couch opened the Working Group Meeting and welcomed the Delegations. He then turned the floor over to Ukraine to comment on the Russian-proposed text on the Ukrainian SS-24 SRM case elimination issue that had been provided to the other delegations at the opening of business today. ¶6. (S) Shevtsov noted that JCIC Joint Statement 44 allowed for phased eliminations of mobile systems without a Treaty amendment. He said the Ukrainian Delegation had provided its proposed Joint Draft Text to the other delegations at the July 18, 2008 Working Group Meeting (Ref B). He highlighted the Russian-proposed changes to the draft Ukrainian Unilateral Statement on the Non-Transfer of SS-24 ICBMs to Third Countries, which had been provided to the other Parties at the opening of business this morning. He noted that the United States had urged Ukraine to issue a statement of policy, in accordance with these new procedures, that would commit Ukraine not to remove any of the rocket motor cases eliminated from the national territory of Ukraine without prior notification. (S) Couch questioned the language in Article One, Subparagraph 4(b) of the Russian-proposed agreement. In particular, he questioned the Russian deletion of the word "may" and replacing it with the word "shall" in the phrase "...the Parties shall agree on procedures for the elimination of such rocket motor cases,..." He said the word "may" was an important distinction that should remain. -------------- SS-24 ELIMINATION: THE STORM -------------- ¶8. (S) Ryzhkov said the Russian Delegation wanted to replace the word "shall"" with "may" so that the new procedures being established to eliminate Ukraine's SS-24 ICBMs could be expanded to include all types of mobile missiles such as the Topol (SS-25),Topol M (SS-27),and Peacekeeper ICBMs. He said other options could be agreed upon, such as varying the number and size of holes required to be drilled. Ryzhkov said the Russian Delegation would work on the draft text and respond later. ¶9. (S) Couch said that the U.S. Delegation would study all three draft documents: the policy statement, the agreement, and the joint statement that each of the parties had provided. He said the primary concern remained the use of the word "may" in the draft agreement. He said, after review, the Parties could again take up this issue. ¶10.
