RESPONSE TO USG-PROPOSED IAEA ADDITIONAL PROTOCOL

1. (U) This is an action request, please see paragraph 4.
2. (C) After conclusion of the November 19-20 Nuclear
Suppliers Group (NSG) Consultative Group (CG) meeting in
Vienna, MFA Nuclear Energy Policy officer, Dr. Joerg Polster,
requested feedback on what the USG plans to do regarding
South Africa's (SA) expected opposition to the Additional
Protocol (AP) contained in revised paragraphs 6 and 7 of the
IAEA Information Circular INFCIRC/254. In addition, Polster
asked if the USG plans to approach Pretoria directly on this
issue. Polster said the USG feedback would be helpful to the
GOG as Germany formulates their response to the draft US
Enrichment and Reprocessing (ENR) proposal for review by NSG
participating governments (deadline December 12).
3. (C) Polster noted SA's interest as a supplier of ENR
technology and opined that SA, which often speaks as a
representative of Non-Aligned Movement (NAM) countries, would
likely interpret the AP as discriminatory. Polster said that
SA would likely cite Article 4 of the Nuclear
Non-Proliferation Treaty (NPT) in regards to SA's rights as a
supplier to export ENR to non-NWS that are signatories to the
NPT. In addition, Polster said he found it strange that SA's
delegation at the CG meeting consisted of only one person and
that SA's primary POC for nuclear related issues, Ambassador
Abdul Minty, was not present.
4. (SBU) Post would appreciate any guidance or information
related to questions posed in PARA 2 that we can release to
Germany.
