Brown for reasons 1.4(b ) and (d) ¶1. (S) Germany will deal with IRISL multilaterally, through the EU's implementation of the Common Position on UN Security Council Resolution 1803. Econoff met with Economics Ministry Office Director Martin Lutz and provided reftel points. Lutz stated that the final EU implementation of UNSCR 1803 will require IRISL (as well as Iran Air) to make pre-arrival and pre-departure declarations of cargo to German customs authorities. IRISL will be required to declare that it has no dual-use, hazardous or other prohibited goods on board. Under UNSCR 1803, IRISL ships are subject to inspection only upon reasonable belief that the vessel is transporting prohibited goods. UNSCR 1803 does not require IRISL to make pre-arrival and pre-departure cargo declarations. Lutz stressed the point that the EU's mandatory pre-arrival and pre-departure declaration requirements are stronger than the limited inspections allowed under UNSCR 1803. Germany is not, however, at this time, unilaterally willing to designate IRISL. ¶2. (S) Lutz assured Econoff that, although the EU's implementation of 1803 is still a work in progress, the above provisions regarding IRISL will remain. Further, these provisions will become European law upon the EU adopting them, obviating any need for German legislative review, adoption or implementation. He stated that November is the current target for the EU to complete its work on the Common Position. TIMKEN JR
