1. (C) POLOFF and Naval Attache delivered ref A demarche and
nonpaper warning China to cease harassment of U.S. Navy
vessels in China's EEZ to MFA Treaty and Law Department
Oceans and Law of the Sea Division Director Yang Li on
November 18.


2. (C) Yang responded that China "cannot accept the blame
that the U.S. side puts on China." Because the U.S. Navy
vessels are "conducting marine scientific research" in
China's EEZ, "prior approval is required by the Chinese
Government," claimed Yang. "These activities are not in
conformity with the good relationship" between China and the
United States, and the "U.S. side should make the right
choice" and "exercise self-restraint."


3. (C) POLOFF responded that the U.S. Navy vessels were
operating in accordance with international law and referred
to the dangerous actions of the PRC naval vessels described
in ref A nonpaper. After asserting that the Chinese ships
were not naval vessels but State Oceanographic Administration
vessels, Yang replied that China "will respect both national
and international law in enforcing China's national laws and
regulations." "The dangerous situations were created by U.S.
activities," asserted Yang, which "are legally and
politically not in conformity with our good relationship."
