AGREEMENT
1. (U) Sensitive but unclassified. Not for public Internet.
2. (SBU) Deputy Foreign Minister Sarybay called in the Ambassador
on October 15 to inform him that President Nazarbayev had signed a
decree on the amended Cooperative Threat Reduction (CTR) Umbrella
Agreement under which the Kazakhstani government recognizes
provisional application of the Agreement from the date of its
signature -- i.e., from December 13, 2007. (NOTE: In a brief
meeting with State Secretary Saudabayev on October 14, the
Ambassador had pressed for this action to be taken by our October 15
deadline. END NOTE.) Sarybay handed the Ambassador an aide memoire
in English confirming Kazakhstan's provisional recognition and
proposing that consultations be held on the implementation of the
Umbrella Agreement and on developing a "new agreement" on biological
threat cooperation. Para 3 provides the full text of the aide
memoire.

Aide Memoire
Astana, October 15. 2008
President Nursultan Nazarbayev signed the Decree confirming
Ambassador Yerlan Idrissov's signature under the Amendment to
Agreement between the Government of Kazakhstan and Government of the
United States concerning the Destruction of Silo Launchers of ICBM,
Emergency Response and the Prevention of the Proliferation of
Nuclear Weapons (referred to henceforth as Umbrella Agreement) done
on December 13, 2007, in Washington, DC.
In accordance with the provision of the Amendment, the Amendment
shall be applied provisionally from the date of signature, shall
enter into force on the date of the receipt by the Government of the
United States of AMERICA of written notification from the Government
of the Republic of Kazakhstan that it has completed the internal
governmental procedures necessary for entry into force, and shall
apply from the date the Agreement entered into force.
The Government of Kazakhstan proposes to hold consultations
concerning development of new agreement on cooperation in biological
sphere, relevant amendments and other issues connected to
implementation of the Umbrella Agreement.
