Reftel requested that post conduct post-shipment verifications at Mohamed Abdul Rahman Al-Bahar company for the shipment of a Marine propulsion engine and a Marine Generator set and associated parts and equipment exported as No License Required by Caterpillar Inc., Peoria, Illinois. ¶2. On 15 Dec 2008, Export Control Officer (ECO) met with Mr. Mushtaq Ahmed Khan, Parts Manager, of Mohamed Abdul Rahman Al-Bahar company. Mr. Khan explained that the Al-Bahar company (www.albahar.com) is the sole agent for all Caterpillar products in all Gulf Cooperation Council (GCC) countries except for Saudi Arabia. Due to this exclusive relationship they are the only company that sells, maintains and represents Caterpillar Inc. in the region. Khan was well aware of U.S. export control laws and explained that as the sole representative of a U.S. company they made sure that all of their transactions abide by U.S. laws and regulations. Regarding both transactions, Khan provided ECO with following information regarding the UAE based end users for these shipments: the Generator set shipment was ordered for Valetine Maritime for a Barge Project in Abu Dhabi; and the Propulsion engine is for the use of ADYARD as a prime mover of a bow thruster of a utility vessel in Abu Dhabi. ¶3. Post considers Mohamed Abdul Rahman Al-Bahar company to be a reliable recipient of U.S. origin equipment for these transactions. OLSON
