1. (U) This is an action request.
2. (C/NF) Subsequent to reftel, Embassy has engaged the
French authorities on the pending export to China from France
of vibrafuge/centrifuge testing system (vibrafuge) partly
manufactured by the U.S. Company Data Physics and assembled
for export by the French company Actidyn Systemes. Our
nonproliferation contacts at the MFA have repeatedly assured
us (most recently on February 6, 2007) that the item remains
in France, and that in the event the French authorities
decide to proceed with exporting the item, we would receive
prior notification.
3. (S/NF) In early February, however, U.S. Department of
Commerce (DOC) and Immigration and Customs Enforcement (ICE)
authorities investigating the U.S. seller of one of the
critical components of the vibrafuge, received information
from a sensitive source alleging that the item was currently
being installed in China (NFI). Embassy therefore requests
immediate instructions for delivery to the MFA requesting 1)
a formal update on the status of the vibrafuge; 2) that
Embassy officers be authorized to inspect the equipment. We
would also like to provide information generated by the
ICE/DOC source to the French authorities and we request that
that information be provided in points for the MFA. Finally,
we think points would serve as a good opportunity in which to
reiterate U.S. concerns that, if this equipment has not been
exported, it should be treated as a non-exportable item
pursuant to MTCR "catch all" provisions, and/or
non-exportable under any other provision of law or agreement.
