1. Unauthorized disclosure of the information provided below is
prohibited by Section 12(c) of the Export Administration Act.
2. Export Control Officer (ECO) Paul Cushman and BIS FSN Prem
Narayan conducted a Post-shipment Verification (PSV) at the
Indraprastha Gas Limited (IGL),New Delhi, on April 20, 2007.
3. BIS requested a PSV on IGL, a Delhi State Government Public
Sector Undertaking (PSU). IGL was listed as the Ultimate Consignee,
Tektronix (India) Ltd., Bangalore, and Agmatel India (Agmatel),New
Delhi as the Foreign Purchaser for one Model TDS3034B Digital
Phosphor Oscilloscope (DPO) controlled under ECCN 3A292. As of
August 30, 2005, BIS decontrolled NP2 controlled items for India
including oscilloscopes. The BIS export license D328864 under which
the subject was covered expired on October 31, 2006. The license
applicant was Tektronix Inc. (Tektronix),Beaverton, OR.
4. Cushman along with Narayan met with Samarendu Chatterjee, Deputy
General Manager (Instrumentation),IGL.
5. This was the first USG or BIS official visit to IGL. Chatterjee
was not aware of the BIS regulations. Chatterjee was cooperative
and provided a copy of IGL Purchase Order. He did not have other
transaction papers such as end-use statement, Tektronix Invoice,
delivery receipt, etc. He promised that he would coordinate with
IGL purchase section to obtain a copy of other shipment papers and
send them to BIS New Delhi. He did not recall receiving final
export license conditions from either Tektronix or Agmatel but he
recalled submitting an end-use statement to Agmatel.
6. Chatterjee confirmed the stated end-use of the oscilloscope. The
oscilloscope is used in the service and maintenance of the gas
pipeline. He stated that IGL distributes compressed natural gas
(CNG) through its gas stations used by automobiles and piped natural
gas (PNG) to domestic and commercial sectors used by household and
small sized commercial units. The oscilloscope is used to detect
the technical breakdown of mass flow meters used for PNG and to
repair electronic cards of CNG dispensing machines.
7. ECO and Narayan were taken to one of the CNG outlets located in
Sector 3 of R.K. Puram, approximately 1.5 kilometers from IGL's
headquarters. In a separate cabin in the corner of this CNG outlet,
IGL's Instrumentation Division Laboratory is operating. The
oscilloscope is used in this laboratory along with other testing and
measuring equipment. ECO and Narayan verified the oscilloscope
model and serial numbers. IGL's CNG outlet is guarded 24 hours a
day.
8. Incorporated in 1998, IGL is a joint venture company of GAIL
Ltd., Bharat Petroleum Corporation and Delhi Government. IGL was
started to lay the network for the distribution of natural gas in
the National Capital Territory of Delhi to consumers in the
domestic, transport, and commercial sectors. The transport sector
uses natural gas as CNG, while the domestic and commercial sectors
use it as PNG. IGL has 154 CNG outlets in Delhi that are fueling
over 128,000 vehicles including buses, passenger cars and taxis.
IGL supplies online cooking gas to over 65,000 households. IGL
employs approximately 280 personnel.
9. Recommendation: All indications were that the listed commodity is
used in accordance with terms of the export license and that the
Indraprastha Gas Ltd. appears to be a reliable recipient of
sensitive U.S.-origin technology for this transaction.
