BIS requested a PLC on HEADQUARTERS, SOUTHERN NAVAL COMMAND (SNC),KOCHI, KERALA. SNC was listed as the Ultimate Consignee and G.S. Teletech, Kochi, Kerala as the Intermediate Consignee for five ASG software key, 21 G700 R3 AC/DC Media gateway gray, one SIP enablement services software, one S8500C Media server, one S8500C Media server RHS, one S8720 Media server RHS, one HW DUP S8720 Media server RHS, and two CM3.1.2 Linux unity software controlled under ECCN 5A002 and 5D002. The license applicant was Celestica Inc., Salem, NH. ¶3. On January 29, 2007, the then Acting ECO Nardella sent a formal request to Under Secretary (AMS) Prashant Agrawal (Agrawal),GOI Ministry of External Affairs to set up a PLC at SNC. Acting ECO Davis assumed charge of BIS New Delhi on February 26, 2007. On February 27, 2007, ECO Davis sent an email to Agrawal reminding him about the four-week deadline per End-Use Visit-Agreement (EUVA). The deadline for completion this PLC was February 28, 2007. In response to ECO Davis' email, Agrawal advised that the order placed by SNC stands cancelled. Agrawal did not cite a reason for the cancellation of the order. However, he verbally communicated to FSN Narayan that SNC informed Agrawal that they are in the process of inviting fresh bids for the same products. ¶4.
