(S) On September 27, MFA Arms Control and Military Technical Cooperation Department Counselor Oleh Belokolos provided us with a non-paper regarding delivery to China of centrifugal charging pumps to China from the Ukrainian company, Sumy Frunze Machine Building Scientific Production Association. Belokolos had earlier provided a response on Ukrainian cooperation with Chinese enterprises regarding development of the RD-120 rocket engine (reftels). Both non-papers are provided below. ¶2. Unofficial translation Releasable to the Government of the United States of America During the regular meeting of the Ukraine - U.S. nonproliferation and export control Working Group in June, 2007, the U.S. Side handed over the unofficial document related to the possible transfer by Ukrainian entity Sumy Frunze Machine Building Scientific Production Association of the centrifugal charging pumps, which could be used to complete repairs at the Chasma Nuclear Power Plant (CHSNUPP) in Pakistan. -- We would like to emphasize that Ukraine, as the member-state of the Nuclear Suppliers Group (NSG) is respectful to its international obligations in the sphere of nonproliferation of nuclear materials and technologies. -- On 22 February, 2007, the Agreement between the Internationals Atomic Energy Agency and the Islamic Republic of Pakistan for the Application of Safeguards in Connection with the Supply of a Nuclear Power Station from the People's Republic of China (INFCIRC/705) has entered into force. According to the Section 2 of this Agreement, Pakistan undertakes that the equipment and materials, which are transferred according to this Agreement, shall be used exclusively for the peaceful purposes. -- The People's Republic of China is the member of the Nuclear Suppliers Group. There is no available information regarding the breach by this country of the NSG Guidelines. ; -- In this connection, we do not consider that the contract between Ukrainian entity Sumy Frunze Machine Building Scientific Production Association and the Chinese company regarding the transfer of the mentioned production will contradict with the NSG Guidelines. On the international transfers of goods from Ukraine to the People's Republic of China in the framework of their cooperation in the sphere of peaceful exploration and use of outer space -- In response to the US Side's inquiry at the regular meeting of the Ukraine - US Nonproliferation and Export Control Working Group (26-27 June, 2007, Kyiv, Ukraine) regarding the international transfers of goods from Ukraine to the People's Republic of China in the framework of their cooperation in the field of the peaceful use and exploration of outer space, we would like to provide the following information. ¶1. In 2007, there were no official contacts between the Ukrainian space industries and enterprises of the People's Republic of China regarding the transfer of technologies concerning the rocket engine RD-120. The Ukrainian enterprises did not transfer technical and engineering information and the sample models of the RD-120 rocket engines to the People's Republic of China. KYIV 00002491 002 OF 002 ¶2. According to the technical specification "Total Impulse Capacity," the rocket engine RD-120 can be classified as MTCR Category I item. As far as we know, three rocket engines RD-120 were sold by the company "Obschemashexport" (Moscow, USSR),and were transferred in 1991 to the company "Viektochmash" (the People's Republic of China). -- At the same time, we would like to inform the US Side that the cooperation between the Ukrainian industries and the enterprises and institutions of the People's Republic of China is being conducted in full accordance with the 1995 intergovernmental Agreement "On the Cooperation in the Sphere of Peaceful Exploration and Use of Outer Space" and the 2006-2010 Plan for Ukrainian-Chinese Cooperation in the above-mentioned sphere, and also ensuring the strict adherence to the requirements of the international export control regimes (in particular, the Missile Technology Control Regime) and Ukraine's international obligations in the nonproliferation sphere. -- Concerning the cooperation between the Ukrainian industries and the Institute 11 of the People's Republic of China, we would like to inform you that the mentioned cooperation has not been conducted in 2007 and is not included in our future plans.
