(U) Summary. Three men were recently found guilty of violating the Anti-terrorism Law by courts in Semarang, Central Java. Beny Irawan and Agung Setyadi were sentenced to 5 years and 6 years respectively for their roles in providing a laptop computer to imprisoned Bali bomber Imam Samudra in May 2005. Samudra, who is currently on death row, allegedly used the computer to communicate with fellow terrorists via email and chat rooms. A third defendant, Mohammad Agung Prabowo, was sentenced to three years for his role in developing a Jihadist website. The three were defended by attorneys from the Muslim Defense Team's Solo office. The sentences imposed were approximately half of the terms requested by the prosecutors. End Summary The Suspects -------------- ¶2. (SBU) Details on the three convicted men are as follows: Beny Irawan aka Abu Hanafi bin Maryoto DOB: 22-May-1977 POB: Banyumas, Central Java Charge: Anti-terror Law, Article 13, aiding and abetting a terrorist Irawan worked as a prison guard at Kerobokan prison in Denpasar, Bali. Irawan received the computer from Setyadi and passed it, along with a cable and adaptor, through the window into Imam Samudra's prison cell. ¶3. (SBU) Agung Setyadi aka Pakne aka Salafuljihad DOB: 18-April 1975 POB: Semarang, Central Java Charge: Anti-terror Law, Article 13, aiding and abetting a terrorist Setyadi, a lecturer in Information Technology at Stikubank University in Semarang, first communicated with Imam Samudra via two chat rooms called "cafeislam" and "ahlusunnah" in January 2005, according to the indictments. In April, 2005, Setyadi received a bank transfer of 3 million Rupiah (about $300 US) from Samudra with instructions to purchase a laptop. Setyadi reportedly added 2.6 million Rupiah of his own funds to purchase the laptop, which he then forwarded to Irawan at Kerobokan prison. ¶4. (SBU) Mohammad Agung Prabowo aka Max Fiderman aka Ahmad aka Agung aka Kalingga aka Bebek-bebekan aka Max Hazer DOB: 11-December-1982 POB: Kudus, Central Java Charge: Anti-terror Law, Article 15, conspiracy to commit terrorism Prabowo, a computer studies student at Semarang University, assisted convicted terrorist Abdul Aziz in the creation of Anshar.net, a website used by terrorists to disseminate information on terrorist tactics and propaganda. The website also reportedly included suggested targets for future attacks in Jakarta. Aziz, currently serving an eight year prison term, developed the website at the request of fugitive terrorist mastermind Noordin M. Top (reftel). The Defense -------------- ¶5. (C) The three men were defended by lawyers from the Muslim Defense Team's (TPM) office in Solo, Central Java. According to our court monitor (protect: Post's relationship with the court monitor is not publicly acknowledged),the Solo group is significantly younger and less experienced than many of the Jakarta-based TPM attorneys. Our court monitor reported that the TPM attorneys yelled at the judge during Irawan's sentencing- request hearing, accusing him of having received JAKARTA 00001718 002 OF 002 a bribe from the Australian government. The TPM also claimed that the USG had intervened in the case, a standard TPM tactic. ¶6. (SBU) The sentences imposed on the three men were approximately half of what prosecutors had requested. According to our contacts, judges routinely impose sentences which are approximately one-third less than the term requested by prosecutors. HEFFERN
