(C) Charge d'Affairs delivered REFTEL points on November 16 to Ruediger Luedeking, MFA Deputy Commissioner for Arms Control and Disarmament. Luedeking noted that the Ministry spokesman would be making a statement about the ElBaradei report during the November 16 midday press conference and that FM Steinmeier would make a statement perhaps as early as Monday. Germany plans to work closely with the United States, particularly in Vienna and in New York, to ensure as strong and unified a response as possible. Luedeking also made clear that Germany believes Iran has not lived up to its international obligations and noted with concern the point in the report regarding the IAEA's "diminishing knowledge" of Iran's nuclear-related activities. ¶2. (C) Luedeking further noted that the GOG supports ElBaradei's calls on Iran to implement the Additional Protocol and to suspend its enrichment activities. He stated that it is important for the UNSC to begin working on a new resolution as a result of Iran's failure to comply with UNSCR ¶1747. Germany believes very strongly that Russia and China need to be kept on board as the EU3 3 and the UNSC move forward. Luedeking also mentioned that he expects Javier Solana to work with the EU Foreign Ministers to issue a strong EU statement on the matter, especially given that Iran has recently avoided meeting with Solana. ¶3. (C) MFA Head of the Arms Control Office, Hellmut Hoffmann informed POLOFF of the points Germany would be making in its public reaction to the ElBaradei report. He stated that if Iran meets its international obligations, the June 2006 EU3 3 offer still stands. While Germany will welcome the cooperation ElBaradei highlights in his report, German officials will also underscore that it is not sufficient to meet the IAEA or UNSC requirements. The GoG will state, therefore, that moving forward on a new UNSCR is necessary, especially since the report cannot verify that Iran is not pursuing undeclared nuclear activities. The GoG will also stress that Iran must fully cooperate on order to restore the international community's confidence, and that to date this has not occurred. Germany will again call on Iran to explain the open questions remaining from past activities, and to must act on this immediately. The GoG will reiterate that, in light of Iran's continued refusal to live up its obligations, the GoG believes it is necessary, per UNSCR 1747, for the UNSC to consider additional measures against Iran.
