(C) Assistant Foreign Minister He Yafei called the Ambassador August 4 to deliver an "urgent" demarche regarding (Taiwan President) Chen Shui-bian's recent letter to the UN seeking to apply for UN membership under the name "Taiwan." AFM He complained that a USUN official on August 3 suggested to the UN Legal Office that the UN Legal Office "was receiving erroneous advice" in rejecting the Taiwan letter with reference to UNSC Resolution 2758 (note: the UNSCR that transferred the UNSC Permanent Member seat from the ROC Chiang Kai-shek government to the PRC government in 1971). This issue had come to the attention of the Chinese leadership, AFM He stated, and the Chinese are upset about this. ¶2.
