UNCLAS NAIROBI 000859 SIPDIS SIPDIS E.O. 12958: N/A TAGS: CVIS SUBJECT: REVOCATION ¶1. Post requests the revocation of a visa as required by 22 CFR 42.82(e) for the following applicant: HASSAN, Neseem Mumbi. ¶2. Date and place of birth: 19-OCT-1990; Nairobi, KENYA. ¶3. Country of nationality and residence: Kenya. ¶4. Date of issuance of visa, date of expiration of visa, and visa symbol: 16-SEP-2005, 14-SEP-2007, F1, foil number ¶75356860. ¶5. Type, number, date, and place of issuance of passport: Regular, A927214, 13-MAR-2005, Nairobi. ¶6. The alien is ineligible under INA section 214(b) and section 212(a)(6)(C). ¶7. The alien is ineligible because she willfully misrepresented her intent to immigrate to the U.S. via the F-1 visa and willfully misrepresented her status as an orphan in Kenya. Post has confirmed that following the issuance of an F-1 visa to Ms. Hassan and her arrival in the U.S., Amcit Verna Jean Turkish began adoption proceedings for Ms. Hassan. When DHS officials in the U.S. pointed-out that Ms. Hassan's birth certificate listed Fauzia Muthoni Kiarie as her mother, Ms. Turkish explained that Ms. Hassan was in fact an orphan and that the mother listed was the director of Ms. Hassan's orphanage, Mama Fauzia's Children's Home. Post has since spoken to Fauzia Hassan, aka Mama Fauzia, aka Fauzia Muthoni Kiarie who said she fraudulently obtained a birth certificate for the child with her name listed as the mother and a fictitious father. She noted that she defrauded both the Government of Kenya (GoK) and the Consulate for the benefit of the child. Fauzia Hassan also confirmed that she had no legal custody over the child. It is clear from the case notes (reference CCD control number 20051081060002 and 20052160340003) that the officers involved believed that the applicant's mother provided a reasonable reason for her to return to Kenya and overcome the assumption of immigrant intent at the time of the interview. Post also notes that we received reassurances and pressure from the Amcit, a member of the U.S. Congress, and a GoK Cabinet Minister to issue the visa. Post has little doubt that the Amcit and Minister Peter Anyang NYONGO knew the true status of the child and the applicant's intent to perpetrate fraud. ¶8. Alien's address and contact information: The applicant currently resides in the U.S, we believe that she lives with Mrs. Turkish at 375 Rock Creek Drive, Ann Arbor MI, phone contact information: 734 663-2774, 734 427-3636, and 734 427-3636. ¶9. Because the applicant currently resides in the U.S, Post requests that Washington revoke Neseem Mumbi HASSAN's F-1 visa foil number 75356860. BELLAMY
