STAY IN KUWAIT IF THEIR EMPLOYING COMPANY IS CLOSED
1. (U) Hamad Al-Ma'dadi, Assistant Undersecretary for Labor
at Kuwait's Ministry of Social Affairs and Labor (MOSAL),
issued instructions in mid-February to allow expatriates
whose families live in Kuwait to stay in the country
temporarily if the company that sponsors them is shut down
for violations of Code 71. Code 71 stipulates that a company
will be closed down if it violates MOSAL regulations on work
or residency permits for its laborers (including illegal visa
trading),if it fails to obtain or renew its commercial
license, or if the company was on a government contract that
has terminated.
2. (U) In the past, workers who worked for companies closed
under this code had to leave the country immediately and
could not return until they arranged for another employer to
sponsor them. There were exceptions for those with Kuwaiti
spouses and for Palestinian refugees. Under Al-Ma'dadi's new
instructions, however, there will also be an exception for
workers with wives and children in Kuwait, since the father's
departure from the country would leave his family destitute.
Such workers will be given a 60-day grace period in which to
find a new sponsoring employer. If they cannot find a new
employer then they will have to leave the country.
