1. On March 20, the Appellate Division of the High Court
rejected the appeal of the Kibria family to re-open the
investigation of the murder case. The judge ruled from the
bench, affirming the earlier holding that only the trial
court had the jurisdiction to determine whether or not a new
investigation was necessary either due to inadequate evidence
or faulty police work.
2. The Appellate Division, like the U.S. Supreme Court, is
the final court of appeal in Bangladesh. The case will
proceed to trial after the Court issues a written decision
based on its oral pronouncement. If the Court follows the
usual pattern in appeals, a written decision will not appear
for at least three months.
