1. (C) The Embassy is generally pleased with the implementing
decree for the Justice and Peace law, which incorporates many
of our suggestions:
-- It clarifies the eligibility provisions and gives judicial
authorities final say over whether they have been met.
-- It extends and strengthens the investigative process.
-- It makes the taking of the "version libre" (voluntary
statement) an interactive and iterative process, so that the
prosecutors can assemble new information from many sources
and use that information at any time during the taking of the
voluntary statement.
-- It also broadens the scope of the "version libre" to
include information about the criminal activities of third
parties and disclosure of all illegal assets.
-- It creates obligations during the parole stage and
requires the judiciary to establish mechanisms to monitor
the parolees.
-- Finally, it gives the prosecutors limited discretionary
powers to provide incentives for third-party front men to
turn over assets they are holding for paramilitary leaders.
These discretionary powers cannot be applied to front men who
are actual paramilitary members or who have been involved in
a violent crime.
