(C) On September 7, Kurdistan Regional Government (KRG) President Masud Barzani sent a letter to the Speaker of the Iraqi Council of Representatives, Mahmud Mashhadani, regarding the controversy of the Iraqi flag issue in the Kurdistan region. Partly done to stem the negative public backlash against Kurdistan Decree #60 (see reftel) and partly done under pressure from the U.S. Embassy, Barzani's letter is less an explanation for the precipitate action taken by the KRG than a demand for action to redesign the flag by the Government of Iraq. As such, Barzani's missive is unlikely to quell the resentment in Baghdad of the Kurds' unilateral action, and may make the already delicate process of altering the national flag, anthem, and emblem even more difficult. ¶2. (C) Begin Text: To: The Honorable Brother Dr. Mahmoud Al Mashhadani Speaker of the Iraqi Federal Council of Representatives Peace be upon you, An artificial noise has been raised lately regarding the lowering of the Iraqi flag in the Region of Kurdistan. Because this news is groundless wholly and partially, I thought it is necessary to send this letter to your Excellency and through you to all esteemed brothers and sisters members of the COR. We were surprised for raising all this noise regarding the so-called lowering of the Iraqi flag in the Region of Kurdistan because the flag of the defunct regime has not been hoisted since the 1991 uprising. After the collapse of the regime in 2003 and during the tenure of the Governing Council, it was decided not to adopt the former flag as a flag for Iraq. It was supposed that a new flag and national anthem expressing the reality of the Iraqi components be adopted and in accordance with Article (12) of the permanent Constitution which was approved in an unprecedented democratic method. It is known that the flag of the regime was adopted after the black coup d'etat in February 1963 and that the three stars represented the unity between Egypt, Syria and Iraq and did not express in any way the reality of Iraq nor did it represent the unity which did not see the light of day. The flag must be a symbol representing the religious and ethnic fabric of this country. Therefore we ask; what does this flag symbolize? And when were the Iraqi people consulted? The flag in its current form was neither approved by the Governing Council nor by the Council of Ministers of the Interim Government or by the transitional parliament and it is being used in different forms. The phrase "God is the greatest" which was added by Saddam is written in different scripts, some write it in the Kofi script or in Al-Ruka'a script while others keep the old flag as it was. However here in the region of Kurdistan and after merging the two administrations, we realized the importance of re-arranging the matter. In some areas, the flag was displayed without the term (God is Great),and in other areas the flag of the 14th of July Revolution was displayed. We hereby emphasize that our decision does not contain any indication to lowering the Iraqi flag, but rather an indication to raise it on all national occasions and until a new flag is approved by the Council of Representatives in accordance with the stipulations of Article (12). The other part of our decision is to prevent Kurdish parties from raising their flags over government buildings and departments. There is no doubt that you may agree with us that the flag of Kurdistan is the flag of the people, which has not been changed since it was designed approximately eighty years ago, and the raising of this flag is our legitimate right as is the practice in most federal systems in most parts of the world. The new Iraqi flag shall be raised with pride after it is approved by your esteemed Council. His Excellency the Speaker, We the Kurds were subjected again to an attack by the media from the same groups which lead the Al-Anfal operations and the use of chemical weapons against us. And because, they cannot repeat that today they resort to practicing BAGHDAD 00003391 002 OF 002 intellectual terror and fabricate false accusations against the Kurds. We do not accept overbidding over the National issues by those who destroyed Iraq. Your Honorable Council is aware of our sincere efforts for the preservation of Iraqi unity and our serious work for National reconciliation. Our central slogan in the Kurdish movement was Democracy for Iraq and fixing the nationalist rights for the people of Kurdistan. We did not separate the struggle of this people from the issue of Democracy in Iraq. We have participated along with most of the political groups that make up your honorable Council in opposing the tyrannical regime and we worked together for overthrowing it. We have also participated positively with all of you since the fall of the regime for building up a unified Democratic Federal Iraq. Our leadership proved its Iraqi aims, along with the preservation of our Nationalist Characteristics and the recognition and respect of the characteristics of others. We were living as one independent administrative entity for twelve years. But, we went with the President, His Excellency Brother Jalal, to Baghdad immediately after the collapse of the regime motivated by our desire for unity of Iraq and in order to put our hand in the hands of our Arab brothers to confront the new Iraqi situation and to build a Democratic Federal Structure. This new entity must be on the basis of an optional union. This was agreed upon before and after the fall of the regime along with full acknowledgement of the plurality that exists in Iraqi society. While we denounce this ferocious attack on our struggling Kurdish people, we warn of the existence of a conspiracy behind these actions aimed at suppressing our legitimate national rights, and making false accusations, and impeding our march and efforts to maintain the unity of Iraq. The artificial noise regarding the lowering of the Iraqi flag in the region of Kurdistan is nothing but an episode in the series of concealment of crimes that are carried out daily against the unarmed and peaceful Iraqis and the failure of the efforts of those malicious people inside and outside Iraq against the people, and its loyal leadership, both Arabs and Kurds. We promise your Excellency and our brothers and sisters the members of the Iraqi CoR that we will raise, in pride and honor, the new Iraqi flag when approved by your esteemed Council in accordance with Article (12) of the permanent Iraqi Constitution. We also emphasize our commitment to our Arab and Kurdish brothers and our respect for the rights of all other ethnicities, Turkmen, Caldeans and Assyrians, and our commitment to a democratic and federal Iraq and its permanent Constitution.
