1. (U) Per reftel request, Econoff wrote to TECRO on August
23, 2006 and sought written confirmation of assurances
provided in reftel to the export case, DTC:999050. The text
of the response letter (received on October 12, 2006) from
the Deputy Secretary General Terry Ting follows:

Dear Mr. Moore:

This is in reference to AIT's letter (B-617) dated August 23,
2006, requesting a written confirmation of assurances for
Defense Trade Controls (DTC) Case #999050 from Chun Shan
Institute of Science and Technology (CSIST).

In reply, I wish to inform you that CSIST has agreed to
comply with the terms of requested assurances which include:

A) The items will not be used in the design, development,
manufacture, launch, or operation of any delivery system for
weapons of mass destruction or in the conversion of any other
delivery system for weapons of mass destruction;

B) The items will be used only for the purpose stated and
such use will not be modified nor the items themselves
modified or replicated without the prior consent of the
American Institute in Taiwan.

C) Neither the items, nor replicas, nor derivatives thereof,
will be retransferred without the consent of the American
Institute in Taiwan; and,

D) For the purpose of these assurances, a delivery system
for weapon of mass destruction is agreed to include any
complete rocket system (including ballistic missiles, space
launch vehicles, and sounding rockets) or unmanned air
Vehicle system (including cruise missile systems,target
drones and reconnaissance drones) that are:

1) intended to deliver nuclear, chemical, or biological
weapons; or

2) capable of delivering at least a 500 kg payload to a
range of at least 300 km.

Enclosed please find a copy of the written confirmation of
assurances provided by CSIST. I would appreciate it if you
could forward the above-mentioned information to the
authorities concerned for the issuance of export permit.
