(U) On September 9, 2005, U.S. Marshals returned Rafael Figueroa (aka Rafael Antonio Beato Pena) to the United States for trial in the U.S. District Court for the Southern District of New York based on a sealed federal indictment charging narcotics offenses. ¶2. (U) Following the issuance of a Dominican arrest warrent based on a USG request for extradition, Garcia was apprehended by the Dominican National Directorate for Drug Control. Garcia subsequently made a free, knowing, and voluntary waiver of further local proceedings before the Criminal Chamber of the Dominican Supreme Court. His decision to submit to U.S. extradition was evidenced by a witnessed, notarized affidavit executed on September 6, 2005. ¶2. (U) Garcia is the 38th fugitive extradited to the United States during the second administration of President Leonel Fernandez. He is the 25th fugitive extradited from the Dominican Republic to the United States in 2005. KUBISKE
