1. (U) On October 24, the Irish Times (newspaper of record)
reported that Bin Muhammad Ayadi Chafiq will make an appeal
on October 25 to the European Court of Justice for the
release of his bank accounts. According to the report, Ayadi
Chafiq, a Bosnian national born in Tunis, is named on a
European Commission list of Al-Qaeda financiers. His appeal
charges EU authorities with acting illegally and infringing
his human rights by freezing his financial assets.
2. (U) According to the report, Ayadi Chafiq is one of 17
individuals who have had their assets frozen within the EU,
and the only person on the list living in Ireland who is
linked directly with Osama Bin Laden. The article added that
Ayadi Chafiq lost an earlier appeal in August 2002 at the
European Court of First Instance. The current appeal charges
that the EU regulation enforcing the freezing of bank
accounts infringes on fundamental principles of EU law and
that it should be up to individual member states to set the
rules regarding assets freezing rather than the EU.
3. (S) According to SIMO colleagues, Ayadi Chafiq is a known
extremist operating in Ireland.
