1. (SBU) Japan should not be listed in the 2009 Special 301
report. Considerations remain unchanged from 2008.


2. (U) Post has reviewed industry submissions per ref and
notes one substantive comment from the International
Intellectual Property Association (IIPA). The IIPA makes
"special mention" of Japan in its own review and recommends
USTR escalate bilateral engagement with Japan on IPR.
However, Japan is actively reviewing current IPR policies and
practices and many of the issues IIPA raises are under public
debate among Japanese stakeholders. The Japanese government
is aware of the importance of a strong IPR regime and engages
with the USG on a range of IPR issues in bilateral talks,
regional venues such as APEC, and multilaterally in the WTO
and WIPO. The GOJ, and Japanese industry, have frequently
and repeatedly noted the need to work with the US to improve
IPR protection and enforcement in other countries, especially
in China, including in the context of making "green
technologies" available to deal with energy/environment
concerns.
